		<description>The truth is finally emerging!  Excellent analysis of the current mess that is English libel and privacy law.  Article 8 of The European Convention on Human Rights is being totally misused by those with something to hide.  I have had it used against me to get private hearings in my libel claim against The Daily Mail, among others.  Surely, this was not the intention of Article 8, as Article 6 says everyone is entitled to a public hearing. English common law and the Civil Procedure Rules also provide for a public hearing.  

The problem is not the law, but its interpretation.  My view as a litigant in person in the libel court is that the Judges are being pressured by the lawyers to make orders on tenuous and even non-existent Article 8 grounds.
They are therefore setting a dangerous precedent. Privacy laws are being developed to help provide a new source of income for libel lawyers at a time when there are fewer libel cases.  

So when the next rich client with something to hide seeks legal advice, he will be told that he will likely succeed in keeping it secret, as Trafigura was likely told.  Was Article 8 used to get the injunction granted?  

Now as for how costs are used tactically and strategically in English litigation to stop legit claims for libel, I have alot to say about that as well!!  Come to my next hearing on 23 October, likely in Court 12 and I will have a lot to say after orders were made in secret against me last Friday, the 16th October, in my absence.
