{"id":8614,"date":"2010-02-26T11:06:33","date_gmt":"2010-02-26T11:06:33","guid":{"rendered":"http:\/\/www.indexoncensorship.org\/?p=8614"},"modified":"2010-03-01T15:59:51","modified_gmt":"2010-03-01T15:59:51","slug":"binyam-mohamed-full-judgment-revealed","status":"publish","type":"post","link":"https:\/\/www.indexoncensorship.org\/newsite02may\/?p=8614","title":{"rendered":"Binyam Mohamed: full judgment revealed"},"content":{"rendered":"<p><em><span style=\"font-style: normal;\"><br \/>\n<\/span><a rel=\"attachment wp-att-5991\" href=\"http:\/\/www.indexoncensorship.org\/newsite02may\/2009\/10\/binyam-mohamed-victory-for-open-justice\/binyam_mohamed-4\/\"><img decoding=\"async\" loading=\"lazy\" class=\"alignleft size-full wp-image-5991\" title=\"binyam_mohamed\" src=\"http:\/\/www.indexoncensorship.org\/newsite02may\/wp-content\/uploads\/2009\/10\/binyam_mohamed.jpg\" alt=\"Binyam Mohamed\" width=\"140\" height=\"140\" \/><\/a><\/em><strong> A court ruled today that the full draft judgment of its ruling on the case of former Guantanamo detainee <a title=\"Index on Censorship: Binyam Mohamed\" href=\"http:\/\/www.indexoncensorship.org\/newsite02may\/tag\/binyam-mohamed\">Binyam Mohamed<\/a>, including sections the Foreign Secretary had attempted to suppress, should be published<\/strong>.<br \/>\n<!--more--><br \/>\n<a title=\"Judiciary: THE LORD CHIEF JUSTICE OF ENGLAND AND WALES THE MASTER OF THE ROLLS and THE PRESIDENT OF THE QUEEN\u2019S BENCH DIVISION\" href=\"http:\/\/www.judiciary.gov.uk\/docs\/judgments_guidance\/mohamed-judgment-26022010.pdf\"> Lord Chief Justice Lord Judge<\/a> said that the paragraph, already the subject of <a title=\"Index on Censorship: BINYAM MOHAMED: CONTINUOUS COVER UP\" href=\"http:\/\/www.indexoncensorship.org\/newsite02may\/2010\/02\/binyam-mohamed-torture-miliband\/\">considerable press comment<\/a> after it was referred to in a letter by the Foreign Office\u2019s barrister, <a title=\"Index:BINYAM MOHAMED REVELATIONS A VICTORY FOR FREE SPEECH\" href=\"http:\/\/blog.indexoncensorship.org\/2010\/02\/10\/free-speech-a-vote-winner\/\">Jonathan Sumption QC<\/a>, should be revealed for the purposes of clarity.<\/p>\n<p>The paragraph reveals the Master of the Rolls, Lord Neuberger\u2019s opinion that members of the security services had a \u201cdubious record\u201d on torture.<br \/>\nThe court emphasised that it had at no point been coerced by the government, pointing to the fact that at all stages of the case, judges had rejected attempts by the Foreign Office to claim that evidence should be concealed.<\/p>\n<p>The full text of paragraph 168 reads:<\/p>\n<blockquote><p>Fourthly, it is also germane that the SyS were making it clear in March 2005, through a report from the Intelligence and Security Committee that \u201cthey operated a culture that respected human rights and that coercive interrogation techniques were alien to the Services\u2019 general ethics, methodology and training\u201d (paragraph 9 of the first judgment), indeed they \u201cdenied that [they] knew of any ill-treatment of detainees interviewed by them whilst detained by or on behalf of the [US] Government\u201d (paragraph 44(ii) of the fourth judgment). Yet that does not seem to be true: as the evidence in this case showed, at least some SyS officials appear to have a dubious record when it comes to human rights and coercive techniques, and indeed when it comes to frankness about the UK\u2019s involvement with the mistreatment of Mr Mohammed by US officials. I have in mind in particular witness B, but it appears likely that there were others. The good faith of the Foreign Secretary is not in question, but he prepared the certificates partly, possibly largely, on the basis of information and advice provided by SyS personnel. Regrettably, but inevitably, this must raise the question whether any statement in the certificates on an issue concerning such mistreatment can be relied on, especially when the issue is whether contemporaneous communications to the SyS about such mistreatment should be revealed publicly.
