{"id":93218,"date":"2011-03-13T11:22:00","date_gmt":"2011-03-13T11:22:00","guid":{"rendered":"http:\/\/blog.indexoncensorship.org\/?p=4798"},"modified":"2011-03-13T11:22:00","modified_gmt":"2011-03-13T11:22:00","slug":"us-judge-rejects-appeal-of-twitter-users-in-wikileaks-case-2","status":"publish","type":"post","link":"https:\/\/www.indexoncensorship.org\/newsite02may\/?p=93218","title":{"rendered":"US judge rejects appeal of Twitter users in Wikileaks case"},"content":{"rendered":"<p>A federal judge in the US ruled on Friday that Twitter must hand over to the government the personal account information of three users connected to WikiLeaks, rejecting their lawyers&#8217; appeal that the First and Fourth Amendments protect such private online communication.<\/p>\n<p>As part of an ongoing grand jury investigation into WikiLeaks, the Department of Justice originally demanded in sealed court documents the Twitter account details &#8212; including personal contact information and IP addresses &#8212; of Dutch businessman <a href=\"http:\/\/en.wikipedia.org\/wiki\/Rop_Gonggrijp\">Rop Gonggrijp<\/a>, U.S. activist <a href=\"http:\/\/www.rollingstone.com\/culture\/news\/the-most-dangerous-man-in-cyberspace-20100818\">Jacob Appelbaum<\/a> and <a href=\"http:\/\/this.is\/birgitta\/\">Birgitta Jonsdottir<\/a>, a member of the Icelandic parliament. The government wanted Twitter to turn over the details without alerting the three that their information had been subpoenaed.<\/p>\n<p>Twitter successfully <a href=\"http:\/\/www.wired.com\/threatlevel\/2011\/01\/twitter\/\">fought that gag order<\/a> in January. But, in trying to have the government\u2019s request entirely thrown out, lawyers for the <a href=\"http:\/\/www.aclu.org\/twitter-wikileaks-court-order-news-and-background\">ACLU<\/a> and <a href=\"https:\/\/www.eff.org\/cases\/government-demands-twitter-records\">Electronic Frontier Foundation<\/a> failed to convince judge Theresa Buchanan that the Fourth Amendment right to privacy protects information like IP addresses &#8212; or that turning over such information would allow authorities to create a \u201cmap of association\u201d of Twitter users that would have a chilling effect on the First Amendment right of free association.<\/p>\n<p>\u201cThe Court finds no cognizable First Amendment violation here,\u201d Buchanan wrote in her <a href=\"http:\/\/www.wired.com\/images_blogs\/threatlevel\/2011\/03\/Twitter-WikiLeaks-Opinion.pdf\">20-page opinion<\/a>. \u201cPetitioners, who have already made their Twitter posts and associations publicly available, fail to explain how the Twitter Order has a chilling effect.\u00a0 The Twitter Order does not seek to control or direct the content of petitioners\u2019 speech or association.\u00a0 Rather, it is a routine compelled disclosure of non-content information which petitioners voluntarily provided to Twitter pursuant to Twitter\u2019s Privacy Policy.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p><strong>Emily Badger<\/strong>: US judge rejects appeal of Twitter users in Wikileaks case<\/p>\n","protected":false},"author":530,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_et_pb_use_builder":"","_et_pb_old_content":"","_et_gb_content_width":"","_mi_skip_tracking":false},"categories":[1],"tags":[700,273],"_links":{"self":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts\/93218"}],"collection":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/users\/530"}],"replies":[{"embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=93218"}],"version-history":[{"count":0,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts\/93218\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=93218"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=93218"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=93218"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
