That explanation is roundly at odds with his now-famous URL: <a href=\"http:\/\/thepsychoexwife.com\/\">thepsychoexwife.com<\/a>.<\/p>\n<p>Morelli comes across as a brute on the blog, referring to his ex-wife as \u201c<a href=\"http:\/\/jezebel.com\/5829601\/dads-psycho-ex+wife-blog-becomes-first-amendment-issue\">Jabba The Hut, with less personality<\/a>,\u201d while intimately \u2013 albeit anonymously \u2013 disclosing bitter details of her alcoholism and their fight to co-parent their two sons. You\u2019d think few people would cue up for this theatre, for an inside look at someone else\u2019s rancorous child custody case. But, at its peak, Morelli claimed the site was getting about 200,000 visitors a month, many of them fellow divorc\u00e9s looking for a community to vent.<\/p>\n<p>All of that was, anyway, before a family court judge <a href=\"http:\/\/www.savethepsychoexwife.com\/wordpress\/wp-content\/uploads\/2011\/06\/Transcript-Redacted1.pdf\">told Morelli to take down the four-year-old site<\/a> this summer. That decision has pleased Morelli\u2019s critics (and his ex-wife), and a lot of media commentators have wondered why Morelli needed a court order in the first place to tell him to do something that seems fairly obviously in the best interests of his children.<\/p>\n<p>The problem, though, is that requiring him to shutter thepsychoexwife.com is likely unconstitutional, violating Morelli\u2019s First Amendment right to free speech. And regardless of what anyone personally thinks of the guy, to borrow from the assessment of one local lawyer, \u201cthere is no doubt that <a href=\"http:\/\/www.phillyburbs.com\/my_town\/doylestown\/divorced-dad-s-blog-becomes-free-speech-test\/article_e726559e-cf6a-542a-abbc-ce967fced4d9.html\">his right to be an unmitigated ass <\/a>has been infringed upon.\u201d<\/p>\n<p>Morelli now has two legal disputes on his hands: one over the custody of his children, and the other over a free-speech question that is now attracting the attention of First Amendment scholars and <a href=\"http:\/\/www.huffingtonpost.com\/2011\/08\/09\/the-psycho-ex-wife-free-speech-fight-over-divorce-blog_n_922802.html\">national media<\/a>. Does a divorced dad have the night to publicly plaster invective about his ex-wife all over the Internet (where, among other people, his 10- and 12-year-old children might see it)?<\/p>\n<p>\u201cThat strikes me as a <a href=\"http:\/\/volokh.com\/2011\/07\/14\/father-shall-take-down-that-web-site-and-shall-never-on-any-public-media-make-any-reference-to-mother-at-all\/\">pretty clear First Amendment violation<\/a>,\u201d blogged First Amendment scholar <a href=\"http:\/\/volokh.com\/\">Eugene Volokh<\/a>, in posting the judge\u2019s ruling on his own popular website. \u201cWhatever the scope of family courts\u2019 authority to protect children\u2019s best interests might be, it can\u2019t extend to criminalizing one adult\u2019s public speech about another adult.<\/p>\n<p>Diane E Gibbons, the judge in the case, obviously disagreed.<\/p>\n<p>\u201cThis is about children,\u201d <a href=\"http:\/\/www.phillyburbs.com\/my_town\/doylestown\/divorced-dad-s-blog-becomes-free-speech-test\/article_e726559e-cf6a-542a-abbc-ce967fced4d9.html\">she said<\/a> in court. \u201cYou may say anything that you would like to say. You may publish it. You may put it on a billboard. But you will not have your children, because that is abusive.\u201d<\/p>\n<p>Morelli is now appealing the decision, and while thepsychoexwife.com has gone dormant, he\u2019s now directing people to a new site: <a href=\"http:\/\/www.savethepsychoexwife.com\/\">savethepsychoexwife.com<\/a>, where he doubles down by now writing about both the ex-wife and the judge. Morelli is collecting donations on the site to pay legal fees that he says have reached $116,000 in seven years. And the next round of court rulings, he argues, could effect just about everyone.<\/p>\n<blockquote><p>\u201cWe are asking for help in this defense because it is an issue that faces any parent that is divorced. Imagine a judge telling you that you cannot talk about your children on \u201cany public media\u201d \u2013 which would include things like Facebook updates, Twitter, or your personal blog \u2013 or you will lose custody.\u00a0 Imagine the far-reaching consequences for bloggers everywhere if orders such as this one are left unchallenged?\u00a0 There goes your online support group.\u00a0 There goes your Facebook and Twitter updates.\u00a0 Your website, personal OR commercial \u2013 ordered gone under threat of incarceration and having your beloved children removed from your custody.\u00a0 <em>This order flies in the face of our civil rights, and your civil rights, too!\u201d<\/em><em> <\/em><\/p><\/blockquote>\n<p>It\u2019s hard to escape the impression that Morelli has forgotten about his children as his court case has reoriented itself to a free speech fight (under the headline \u201c<a href=\"http:\/\/www.savethepsychoexwife.com\/the-today-show-addendum\/\">What I\u2019m Really Fighting For<\/a>,\u201d Morelli explains that it\u2019s to \u201cprevent our support group \u2013 and every other one out there \u2013 from being silenced\u201d). He also seems like a particularly unlikely leader for the 21<sup>st<\/sup> century cause of free speech on the Internet (he expresses fundamental na\u00efvt\u00e9 about the medium when he writes that his original blog \u201c<a href=\"http:\/\/www.savethepsychoexwife.com\/\">has no affect on his children<\/a>.
