{"id":93356,"date":"2011-09-06T14:34:14","date_gmt":"2011-09-06T14:34:14","guid":{"rendered":"http:\/\/blog.indexoncensorship.org\/?p=6084"},"modified":"2011-09-06T14:34:14","modified_gmt":"2011-09-06T14:34:14","slug":"european-court-to-examine-donkey-bloggers-case","status":"publish","type":"post","link":"https:\/\/www.indexoncensorship.org\/newsite02may\/?p=93356","title":{"rendered":"European court to examine Donkey Bloggers&#039; case"},"content":{"rendered":"<p>The European Court of Human Rights will this month <a title=\"RSF: European Court to examine case of two bloggers who were unjustly jailed\" href=\"http:\/\/en.rsf.org\/azerbaijan-european-court-to-examine-case-of-02-09-2011,40880.html\" target=\"_blank\">examine<\/a> complaints against <a title=\"Index on Censorship: Azerbaijan\" href=\"http:\/\/www.indexoncensorship.org\/newsite02may\/tag\/azerbaijan\/\" target=\"_blank\">Azerbaijan<\/a>\u00a0filed\u00a0by <a title=\"Index on Censorship - Azerbaijan: Donkey Bloggers punished\" href=\"http:\/\/www.indexoncensorship.org\/newsite02may\/2009\/11\/azerbaijan-donkey-bloggers-punished\/\" target=\"_blank\">bloggers\u00a0Emin Milli\u00a0and\u00a0Adnan Hajizade<\/a>. The pair claim\u00a0that their detention from July 2009 to November 2010 and subsequent conviction violated articles of the European Convention on Human Rights.<\/p>\n<p><a title=\"RSF - European Court to examine case of bloggers who were unjustly jailed\" href=\"http:\/\/en.rsf.org\/azerbaijan-european-court-to-examine-case-of-02-09-2011,40880.html\" target=\"_blank\">Reporters Without Borders explains<\/a>:<\/p>\n<blockquote><p>The complaint filed by Milli and Hajizade says that Article 6, on the right to a fair trial, was violated because they were allowed only belated access to their lawyers and because they court took no account of what their lawyers said.<\/p>\n<p>Article 8 on respect for private and family life was violated, according to the complaint, because the two bloggers were denied family visits while held and certain family members were not allowed to testify at the trial.<\/p>\n<p>Article 10 protects the right to freedom of expression, including the \u201cfreedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.\u201d<\/p><\/blockquote>\n<p>The two prominent youth activists were\u00a0arrested in July 2009 on charges of \u201chooliganism\u201d and \u201cinflicting minor bodily harm\u201d, after a fight in a restaurant in downtown Baku. Reports and <a title=\"Global Voices - Azerbaijan: Youth activists and bloggers beaten and detained \" href=\"http:\/\/globalvoicesonline.org\/2009\/07\/08\/azerbaijan-youth-activists-beaten-and-detained\/\" target=\"_blank\">eyewitness accounts<\/a> have said the pair were talking among a group of other civil society figures when they were severely beaten by two sportsmen, who it has been alleged were government-orchestrated provocateurs. After Milli and Hajizade filed a complaint with police, they were arrested, although their assailants were let go, raising <a title=\"RFE\/RL - Youth Activists Arrested In Azerbaijan \" href=\"http:\/\/www.rferl.org\/content\/Youth_Activists_Arrested_In_Azerbaijan_\/1773150.html\" target=\"_blank\">suspicions<\/a> that the duo&#8217;s attack and arrest were linked to their activism.<\/p>\n<p>In November of the same year, having both been held in prison for over four months, the pair were sentenced. Hajizade received a two-year sentence and Milli two-and-a-half years. They were <a title=\"Global Voices Advocacy - Azerbaijan: \u2018Donkey bloggers' released \" href=\"http:\/\/advocacy.globalvoicesonline.org\/2010\/11\/19\/azerbaijan-donkey-bloggers-released\/\" target=\"_blank\">released<\/a> a year later, although their\u00a0convictions have not been overturned.\u00a0The\u00a0Presidency of the European Union,\u00a0Parliamentary Assembly of the Council of Europe\u00a0(PACE),\u00a0Organisation for Security and Cooperation in Europe\u00a0(OSCE) and various rights groups <a title=\"Global Voices - Caucasus: 2009 blog review\" href=\"http:\/\/globalvoicesonline.org\/2009\/12\/31\/caucasus-2009-blog-review\/\" target=\"_blank\">all condemned<\/a> the verdict.<\/p>\n<p>Both bloggers had been prolific in using social media platforms such as YouTube, Facebook, and Twitter to mobilise Azerbaijani youth mobilise <a title=\"OL! Blog - \u201cOL!\u201d Azerbaijan youth movement manifesto\" href=\"http:\/\/ol-az.blogspot.com\/2006\/06\/ol-azerbaijan-youth-movement-manifesto.html\" target=\"_blank\">opposition against the government<\/a>, speaking out against high-level corruption, misuse of oil revenues and censorship.<\/p>\n<p>Prior to their arrest, the pair had earned their title &#8220;<a title=\"Index on Censorship: AZERBAIJAN: DONKEY BLOGGERS PUNISHED\" href=\"http:\/\/www.indexoncensorship.org\/newsite02may\/2009\/11\/azerbaijan-donkey-bloggers-punished\/\" target=\"_blank\">Donkey Bloggers<\/a>&#8221; <a title=\"New York Times - In Azerbaijan, a Donkey Suit Provokes Laughs and, Possibly, Arrests \" href=\"http:\/\/www.nytimes.com\/2009\/07\/15\/world\/asia\/15azerbaijan.html\" target=\"_blank\">by posting a video<\/a> satirising the country&#8217;s government for having spent a large amount of state money importing two donkeys from Germany.
