{"id":93444,"date":"2011-12-09T17:49:14","date_gmt":"2011-12-09T17:49:14","guid":{"rendered":"http:\/\/blog.indexoncensorship.org\/?p=7043"},"modified":"2019-09-16T13:28:33","modified_gmt":"2019-09-16T12:28:33","slug":"pcc-information-commissioner-leveson-inquiry","status":"publish","type":"post","link":"https:\/\/www.indexoncensorship.org\/newsite02may\/?p=93444","title":{"rendered":"PCC &quot;should have done more&quot;, ex-Information Commissioner tells Inquiry"},"content":{"rendered":"<p>The former Information Commissioner told the <a title=\"Index on Censorship - Leveson Inquiry\" href=\"http:\/\/blog.indexoncensorship.org\/category\/leveson-inquiry-2\/\" target=\"_blank\" rel=\"noopener noreferrer\">Leveson Inquiry<\/a> he was disappointed by the Press Complaints Commission&#8217;s lax response to allegations of illegal activities among the British press.<\/p>\n<p>Richard Thomas said he wanted &#8220;loud, strident condemnation&#8221; from the regulator, having written to them in November 2003 after being advised by the ICO&#8217;s legal team that prosecuting journalists over the use of private investigators would be too costly. Yet he\u00a0was told by PCC Chairman Sir Christopher Meyer that the regulator&#8217;s role was not to enforce the law. Thomas said he &#8220;just did not buy that line&#8221;, that the PCC could not intervene because the use of private investigators by the press was a criminal matter.<\/p>\n<p>&#8220;I thought their response was less strident [than I expected],&#8221; Thomas said. &#8220;I think they could have and should have done more.&#8221;<\/p>\n<p>He added that attempts to develop a &#8220;guidance note&#8221; with the PCC ground to a halt in April 2004.<\/p>\n<p>Thomas reflected that, &#8220;with hindsight, I think I would&#8217;ve been more aggressive and assertive&#8221; with the PCC.<\/p>\n<p>He noted his surprise and outrage at the PCC&#8217;s assertion that the <a title=\"ICO - What Price Privacy\" href=\"http:\/\/www.ico.gov.uk\/news\/current_topics\/what_price_privacy_now.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">ICO&#8217;s report on Motorman&#8217;s findings<\/a> had &#8220;come out of the blue&#8221;, given that Thomas and PCC representatives had had two meetings about its contents.<\/p>\n<p>Thomas described the data breaches exposed by Operation Motorman as &#8220;pernicious&#8221;, and felt deterrents would prevent further wrongdoing.\u00a0In a &#8220;breakthrough&#8221; government consultation paper issued in July 2006, Thomas proposed two-year prison terms for those found guilty of trading in\u00a0illegal data.<\/p>\n<p>He admitted he was not expecting a &#8220;powerful campaign&#8221; of hostility from the tabloids. &#8220;It left me with the message that we were challenging something that went to the heart of tabloid activity,&#8221; he said. &#8220;As somebody said to me &#8216;you do realise you are challenging their business model&#8217;.&#8221;<\/p>\n<p>Thomas reiterated his agenda &#8220;was not to send journalists to prison&#8221;, but to correct bad behaviour.<\/p>\n<p>The Inquiry continues on Monday, with evidence from former News International staff.<\/p>\n<p><em>Follow Index on Censorship\u2019s coverage of the Leveson Inquiry on Twitter \u2013\u00a0<a title=\"Twitter - IndexLeveson\" href=\"http:\/\/twitter.com\/IndexLeveson\" target=\"_blank\" rel=\"noopener noreferrer\">@IndexLeveson.<\/a><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p><strong>Marta Cooper:<\/strong> PCC &#8220;should have done more&#8221;, ex-Information Commissioner tells Inquiry<\/p>\n","protected":false},"author":57,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_et_pb_use_builder":"","_et_pb_old_content":"","_et_gb_content_width":"","_mi_skip_tracking":false},"categories":[3815],"tags":[7427,14339,1759,14360,14361],"_links":{"self":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts\/93444"}],"collection":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/users\/57"}],"replies":[{"embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=93444"}],"version-history":[{"count":1,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts\/93444\/revisions"}],"predecessor-version":[{"id":109297,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts\/93444\/revisions\/109297"}],"wp:attachment":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=93444"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=93444"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=93444"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
