{"id":93512,"date":"2012-02-08T13:22:55","date_gmt":"2012-02-08T13:22:55","guid":{"rendered":"http:\/\/blog.indexoncensorship.org\/?p=7731"},"modified":"2012-02-08T13:22:55","modified_gmt":"2012-02-08T13:22:55","slug":"twitter-joke-trial-a-steamroller-to-crack-a-very-small-nut","status":"publish","type":"post","link":"https:\/\/www.indexoncensorship.org\/newsite02may\/?p=93512","title":{"rendered":"Twitter joke trial &quot;a steamroller to crack a very small nut&quot;"},"content":{"rendered":"<p>The \u201ctwitter joke trial\u201d reached the appeal court today, with the lawyer for accountant Paul Chambers arguing that his conviction for sending a \u201cmenacing\u201d tweet was \u201ca steamroller to crack a very small nut\u201d.<\/p>\n<p>Chambers, 28, is appealing his conviction for sending a joke tweet in early 2010 claiming that he would blow Robin Hood airport \u201csky high\u201d if his planned trip to Northern Ireland to visit his now-fiancee was affected by weather conditions.<\/p>\n<p>Ben Emmerson QC, acting for Chambers, said that Chambers\u2019s conviction did not make sense either as punishment or deterrent.<\/p>\n<p>Emmerson told the court \u201cA message intended as a joke, in a context where there is no public order threat where those who read it did not see it as a credible threat should not be an offence.\u201d<\/p>\n<p>Robert Smith QC, acting for the Crown Prosecution Service, said that the tweet had not been seen as a joke by airport staff.<\/p>\n<p>He added that the message contained no clue of the circumstances leading to the \u201cmenacing\u201d tweet, and that the airport and police could not have known it was a joke until Chambers had been arrested and questioned.<\/p>\n<p>The CPS argued that despite the fact that Chambers was being punished for being foolish, it was nonetheless important that there should be a deterrent to the sending of potentially threatening messages.<\/p>\n<p>The appeal was heard before a capacity audience at the Royal Courts of Justice, including Father Ted and Ladykillers writer Graham Linehan <a href=\"http:\/\/blog.indexoncensorship.org\/2010\/11\/11\/twitter-joke-trial-paul-chambers-graham-linehan\/\">(who has written about the case for Index<\/a>) and &#8220;Pub Landlord&#8221; comic Al Murray.<\/p>\n<p>A judgment is expected before Easter.<\/p>\n","protected":false},"excerpt":{"rendered":"<p><strong>Padraig Reidy<\/strong>:Twitter joke trial &#8220;a steamroller to crack a very small nut&#8221;<\/p>\n","protected":false},"author":2,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_et_pb_use_builder":"","_et_pb_old_content":"","_et_gb_content_width":"","_mi_skip_tracking":false},"categories":[1],"tags":[7126,14123,2255,700,2940],"_links":{"self":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts\/93512"}],"collection":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=93512"}],"version-history":[{"count":0,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=\/wp\/v2\/posts\/93512\/revisions"}],"wp:attachment":[{"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=93512"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=93512"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.indexoncensorship.org\/newsite02may\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=93512"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
