{"id":93632,"date":"2012-06-26T08:23:08","date_gmt":"2012-06-26T08:23:08","guid":{"rendered":"http:\/\/blog.indexoncensorship.org\/?p=8899"},"modified":"2012-06-26T08:23:08","modified_gmt":"2012-06-26T08:23:08","slug":"richard-wilson-durand-academy-libel-lambeth","status":"publish","type":"post","link":"https:\/\/www.indexoncensorship.org\/newsite02may\/?p=93632","title":{"rendered":"Durand Academy gives up libel claim"},"content":{"rendered":"<p>In May 2011, I wrote about the <a title=\"Index on Censorship - Libel in the schoolyard\" href=\"http:\/\/www.indexoncensorship.org\/newsite02may\/2011\/05\/libel-durand-academy-school\/\" target=\"_blank\">epic libel battle<\/a> between a south London primary school, Durand Academy, and Lambeth Council. Durand had been funding a defamation action over three emails in which Lambeth&#8217;s Chief Auditor raised concerns about the school&#8217;s management. At the time, costs in the case were already believed to have exceeded \u00a3100,000.<\/p>\n<p>This week it was announced that the case had finally reached a happy conclusion. On 25\u00a0June, the day that the full libel trial was due to begin, Durand&#8217;s barrister stood up in court and announced: \u201cThe claimants feel they have achieved the purpose for which they brought these proceedings and can now draw a line under this matter.&#8221; (See statement below)<\/p>\n<p>Whereas the claimants had been concerned that a briefing note sent round by Lambeth&#8217;s then Chief Auditor, Mohammed Khan, had made \u201ca serious allegation of financial impropriety,\u201d the defendants had made it clear that \u201cit was never Mr Khan&#8217;s intention to make such an allegation, which they accept would have been quite untrue\u201d. The defendants also accepted that \u201cthe claimants were upset by the contents of the briefing note, and they regret this\u201d.<\/p>\n<p>All good then. This unfortunate misunderstanding has now been resolved to everyone&#8217;s satisfaction. Except that, given the nature of English libel law, to get this far both sides will have had to spend enormous amounts of money. Interim judgements <a title=\"BAILII - McLaughlin &amp; Ors v London Borough of Lambeth &amp; Anor [2010] EWHC 2726 (QB) (02 November 2010) \" href=\"http:\/\/www.bailii.org\/ew\/cases\/EWHC\/QB\/2010\/2726.html\" target=\"_blank\">like this one <\/a>don&#8217;t come cheap. In the previous libel case Durand were involved in &#8212; against the father of a former teacher at the school &#8212; their side alone <a title=\"Richard Wilson - State-funded primary school spent \u00a3244,000 on libel case against father of former teacher \" href=\"http:\/\/richardwilsonauthor.wordpress.com\/2012\/01\/27\/state-funded-primary-school-discloses-legal-costs-of-over-387000-since-2008\/\" target=\"_blank\">incurred legal fees of over \u00a3244,000<\/a>.<\/p>\n<p>Given that in the latest case both Lambeth and Durand are state-funded bodies, whoever is picking up the inevitably substantial tab, the taxpayer seems destined to be the loser.
