November is a month of historical anniversaries. Last Thursday was the annual commemoration of the foiling of the Gunpowder Plot and yesterday the UK fell silent to pay tribute to its war dead on Remembrance Sunday.
A much lesser-known date — at least to anyone outside Azerbaijan — is the country’s Flag Day, the celebration of the tricolour which was first adopted as the national flag on 9 November 1918.
The flag hoisted in the capital city of Baku was once confirmed by the Guinness Book of Records as being the tallest in the world. It flies on a pole 162 meters high and measures 70 by 35 meters. While the flag underwent a hiatus while Azerbaijan was part of the Soviet Union between 1920 and 1991, it is now a proud symbol of the country’s independence.
The tricolour consists of three horizontal stripes, each being deeply symbolic. The blue stripe stands for the Turkish origin of Azerbaijani people and the green stripe at the bottom expresses affiliation to Islam. Neither can be disputed. The red stripe in the middle, however, is problematic. It stands for progress, modernisation and democracy.
But Azerbaijan’s status as a modern democracy is less than convincing. Sure, the country has made some significant strides since the collapse of communism. It boasts a 98.8% literacy rate, and since the early 2000s spending on education has increased five-fold, for example.
However, there is an illusion of material progress in Azerbaijan. As Index on Censorship has been reporting, the country has experienced an unprecedented crackdown on human rights and freedoms.
Little over a week ago, Azerbaijan held a parliamentary election while an estimated 20 prisoners of conscience sat in prison. Azerbaijani journalist Khadija Ismayilova, who was sentenced to seven years and six months in jail in September for exposing state corruption, is one of them. The award-winning journalist was detained on 5 December 2014 and eventually convicted of libel, tax evasion and illegal business activity.
President Ilham Aliyev’s government has long claimed that “all freedoms are guaranteed in Azerbaijan“. Given his government’s lack tolerance for dissent, this clearly isn’t the case. Leyla Yunus, founder and director of the Institute for Peace and Democracy, and her husband, historian Arif Yunus — both outspoken critics of the government — have been detained since summer 2014 when they were arrested on charges of treason and fraud. On 13 August, the Baku Court on Grave Crimes sentenced Leyla to eight years and six months in prison and Arif to seven years in prison.
Democracy activist Rasul Jafarov, human rights lawyer Intigam Aliyev and journalist Seymur Hezi are also serving prison sentences on charges that were widely condemned for being politically motivated to silence outspoken critics of the government of President Aliyev.
The list of journalists and activists who have been arrested, abused, beaten and even killed goes on. In June 2015, on the eve of the inaugural European Games in Baku, activists from Amnesty International and Platform were banned from entering the country. Both organisations have been highly critical of Aliyev’s government, and its continuing targeting, jailing and prosecution dissenters. Even The Guardian was blocked from reporting on the games when its reporter was barred.
Flag Day is set against a backdrop of arrests and human rights abuses. If Azerbaijan is to earn its stripes, the authorities must uphold their human rights obligations, release all prisoners of conscience and allow for elections that meet basic democratic standards.

Judges look for courage, creativity and resilience. We shortlist on the basis of those who are deemed to be making the greatest impact in tackling censorship in their chosen area, with a particular focus on topics that are little covered or tackled by others.
Nominees must have had a recognisable impact in the past 12 months.
Where a judge comes from a nominee’s country, or where there is any other potential conflict of interest, the judge will abstain from voting in that category.

The court case against Malaysian cartoonist Zunar on nine charges of sedition was due to begin today, carrying a maximum penalty of 43 years in prison. Instead, the artist and his lawyers filed applications to have their cases referred to the high court, mounting a constitutional challenge to the country’s Sedition Act and delaying the case against them.
Zunar’s lawyer, Eric Paulsen, who was also due to face charges of sedition this morning, says the Sessions Court, which was due to hear the case, does not have jurisdiction to do so. He has posed the following three points for consideration by the court:
1 Whether section 3(3) of the Sedition Act 1948 is unconstitutional as it states that the “intention” of the maker “shall be deemed to be irrelevant” when making the seditious statement;
2 Whether the Sedition Act unlawfully criminalises peaceful expression of free speech and is thus unconstitutional;
3 The recent Federal Court case in PP v Azmi Sharom misread the constitution and should be reconsidered. Under Article 10(2), “Parliament may by law impose” restrictions on fundamental rights. Therefore, as the Sedition Act pre-dates the Constitution, it cannot be read into Article 10(2) to restrict freedom of speech.
The Malaysian Federal Court dismissed a similar constitutional challenge against the Sedition Act by University of Malaya law lecturer Dr Azmi Sharom early last month. Zunar’s application is now fixed for a hearing on 8 December, and the decision will be made on 15 December.
In the meantime, there are no trial dates set for the sedition case against Zunar and his lawyers.
Zunar has just returned to Malaysia, after visiting the UK to raise awareness of his case and mount an exhibition of his work at London’s Cartoon Museum.
Journalists in Kosovo experiencing harassment or receiving threats can call a new 24/7 helpline for support and advice. Launched in October by the Association of Professional Journalists of Kosovo (AGPK) and the OSCE Kosovo Mission, the phone line is accompanied by an awareness campaign urging journalists to report all cases of intimidation and violence.
Journalist Zekirja Shabani, head of the AGPK, says he would have greatly benefitted from such a helpline when he was set upon by his boss back in December 2014. The owner of the Pristina-based daily Tribuna physically assaulted him after Shabani said he would sue the paper for failing to pay its staff in time.
“As a reward I was attacked and fired from the job,” Shabani told Index on Censorship.
Though Shabani immediately reported the attack to the police, he says there was no followup. Still, it was worth it, Shabani concludes. “It was a good signal for other journalists to raise their voice and fight for their rights.”
Attacks, intimidation and pressure on journalists are common in Kosovo. According to the AGPK, the number of threats and attacks increased from 15 in 2013 to 27 in 2014. “This is a sign that journalists are working in a dangerous environment,” says Shabani. “And a lot of them are not reporting the threats for different reasons.”
The phone line could help break the silence and make it easier for journalists to talk about violence and intimidation, Shabani believes. “There’s a real need for all journalists to have a chance to raise their voice and speak out about their problems in full confidentially.”
The phone is manned by members of the AGPK only. “We don’t have the capacity to hire anyone else,” Shabani explains. Each staff member mans the mobile phone, which they take home overnight, on one-week rotations.
During the first week that Shabani was in charge of the phone, he received two phone calls. “Clearly there is still a need to increase awareness and let journalists know that someone is taking care of them,” he says.
Journalists calling the helpline will be advised and directed towards institutions which can further help them, such as the police or a lawyer. The AGPK has a law firm on stand-by 24/7.
Meanwhile, the organisation will also collect all the data from calls to get a clearer picture of the status of media freedom in Kosovo. Index on Censorship’s Mapping Media Freedom project has reported 15 violations in the country since May 2014. The AGPK has reported 27 incidents in 2014 alone. Human Rights Watch found 22 cases of physical violence and threats in the period between January and November 2014.
These statistics are just the tip of the iceberg as so few journalists report incidents to the police.
The helpline could make it easier for journalists like these to report their cases, Shabani hopes.
The helpline also documents violations of workers’ rights. “We already know that a huge number of journalists are working without contracts, not being paid on time and in bad working conditions,” says Shabani. “The helpline could help the fight for better rights for journalists in general.”

On 11 October, Belarusian president Aleksander Lukashenko won his fifth consecutive election. Whether it was a free and fair election is up for debate.
Belarusian observers, particularly Human Rights Defenders for Free Elections, note the electoral process did not meet a number of core international standards. Claims include that candidates did not receive equal media access, there was a lack of impartiality among election commissions and administrative resources were used in favor of the incumbent. While ballots were cast, political prisoners were held in penitentiaries and there were reports of journalists being harassed.
Even the record share of 36 per cent for early votes need not signal enthusiasm from the electorate. In fact, the early casting of ballots raises concerns of electoral fraud. On 6 October, the deputy dean of the Brest State Technical University, Sviatlana Coogan, stopped two freelance journalists, Aliaxander Liauchuk and Milana Harytonava, from recording interviews with students at a polling station, who said they were forced to participate in early voting by a university representative.
Observers could not visibly ensure the safety of ballots after 7pm and a number of journalists were blocked from working at polling stations during early voting.
Arciom Lyava, a correspondent for the independent newspaper Novy Chas, was forced by clerks to stop photographing a polling station in the Leninski district of Minsk. “As set forth by law, I was taking photos,” he said. This angered Alena Pazenka, headmaster of the school where the station was located. “She stated I was hindering the electoral process. Poll clerks then drew up a statement in relation to me and turned me out from the polling station.”
On election day, at least three other journalists were blocked from documenting events at polling stations. A correspondent for the Polish website Eastbook.eu was blocked from filming the vote count by clerks of a local electoral commission in the Pervomaisky district of Minsk. The chairperson of the commission, Natalia Kunouskaya, threatened to call the police and clerks had fenced off the counting area with chairs so observers couldn’t get close.
As state-run media dominates the landscape in Belarus, the internet is a very important alternative source of information. However, online freedoms were also curbed during the election. During the presidential campaigns, two websites of the privately-owned press agency BelaPAN, were temporarily inaccessible. Sources at the press agency said cyber attacks were launched after they published a critical article about a multi-religious ceremony attended by Lukashenko. The piece featured interviews with students who say they were ordered to attend the event and meet the president. The Belarusian Association of Journalists has expressed concern about the attack, especially in the midst of the electoral campaign.
Blocking access to information about the work of electoral commissions is a common practice for the Belarusian authorities. The independent newspaper Nasha Niva claims that results at some polling stations were re-written after counts were finalised. The data publicised upon completion of vote counting at district electoral commissions did not always coincide with respective results announced at territorial electoral commissions, she says. Niva requested an opportunityto see the results of all polling stations in Minsk from Lidziya Yarmoshyna, chairperson of the Central Electoral Commission. The reply said that the commission did not have the documents, which were at the Minsk City Commission. The city commission did not respond to the request.
The election was followed by an attack on prominent blogger Viktar Nikitsenka who contributed to Radio Liberty Moscow, the radio station Echo Moskvy and korrespondent.net, influential Ukrainian news website. On 13 October 2015, Nikitsenka protested in Minsk’s Independence Square to make his disapproval of the election result known. Friends photographed him outside government buildings holding a sign that read “Lukashenka On Trial”.
Several men in civilian clothes watched from nearby. One of them later approached Nikitsenka and demanded to see his ID and notebook. Half an hour later, when the blogger was leaving the square with his friends, a group of alleged plain-clothes officers seized him in an underpass and dragged him onto a bus. While he was detained, Nikitsenka said was insulted, intimidated and beaten. All his equipment was stolen and data was deleted from his phone and camera. He was taken to the police station, where he was held for approximately two hours before being found guilty of holding an unsanctioned picket, disobeying police officers and insulting a judge at the Maskouski district court. He was fined $492.68 (£319.87).
Nikitsenka later filed a complaint against the officers for unlawful use of force, threats and insults, but it was rejected by the Chyhunachny police department.

UPDATE: Unconfirmed reports are circulating that Khartabil has been secretly sentenced to death by the Syrian government. We ask the Syrian authorities to reveal Khartabil’s whereabouts and release him immediately and unconditionally.
Syria’s authorities have yet to disclose the whereabouts of Bassel Khartabil, a software developer and defender of freedom of information, one month after his transfer to an undisclosed location, 22 organizations said today. Syrian authorities should immediately reveal his whereabouts and release him.
Military intelligence detained Khartabil on March 15, 2012. On October 3, 2015, Khartabil managed to inform his family that security officers had ordered him to pack but did not reveal his destination. His family has received no further information. They suspect that he may have been transferred to the military-run field court inside the military police base in Qaboun.
“Each day without news feels like an eternity to his family,” a spokesperson for the organizations said. “Syrian authorities should immediately reveal his whereabouts and reunite him with them.”

International law defines an enforced disappearance as an action by state authorities to deprive a person of their liberty and then refuse to provide information regarding the person’s fate or whereabouts.
Military field courts in Syria are exceptional courts that have secret closed-door proceedings and do not allow for the right to defense. Based on accounts by people who have appeared before these courts, the proceedings were perfunctory – lasting minutes – and did not meet minimum international standards for a fair trial. During a field court proceeding on December 9, 2012, a military judge interrogated Khartabil for a few minutes, but he had heard nothing about his legal case since then.
A Syrian of Palestinian parents, Khartabil is a 34-year-old computer engineer who worked to build a career in software and web development. Before his arrest, he used his technical expertise to help advance freedom of speech and access to information via the internet. Among other projects, he founded Creative Commons Syria, a nonprofit organization that enables people to share artistic and other work using free legal tools. Despite his imprisonment, Khartabil’s digital work is still advancing knowledge; last month, colleagues produced a new 3D model of the ancient Palmyra ruins using data collected by Khartabil before his detention. The UNESCO world heritage site is currently being destroyed by Islamic State, also known as ISIS, fighters, but the project was able to reconstruct their earlier appearance based on Khartabil’s measurements.
So far this year, five secularists have been hacked to death with machetes by hardline Islamists in Bangladesh. Four writers — Avijit Roy, Washiqur Rahman Babur, Ananta Bijoy Das, and Niloy Chakrabarti — have been murdered, and on 31 October, Faisal Arefin Dipan, who published Roy’s books, was killed at his office in Dhaka. Two secular bloggers and another publisher were badly injured in a similar attack just hours earlier.
This spate of attacks began in earnest in 2013, when atheist writer Asif Mohiuddin was attacked with machetes. While he survived, blogger Ahmed Rajib Haider, attacked a month later, wasn’t so fortunate. At the time, the attacks were linked to political tensions over the ongoing war crimes tribunal. Today, the brutal assaults on secularists seem to have taken on a life of their own and the government has failed to take any decisive action, meaning secularists have been marked out as an easy target. “We don’t want to be seen as atheists,” said the prime minister’s son, Sajeeb Wazed, in May.
In 2013, militant Islamists issued a hit list of 84 bloggers. Numerous other lists are in circulation. For those who are under threat, the situation is terrifying: amongst the small community of “freethinkers”, as they describe themselves, there is a sense that no one is safe. One blogger, who wrote on feminism and religion who wished to remain anonymous, arrived in Europe on 30 October, the day before Dipan was murdered. “I had direct threats to my life; I stopped blogging but the threats continued and I couldn’t even leave the house. Even now, I can’t believe that I’m safe,” she told me over the phone.
The feeling is shared among many atheist bloggers, who use pseudonyms out of fear of reprisals. Prithu Sanyal (not his real name) was a mid-level government employee in Bangladesh who blogged for years on different online forums for atheist writers. He comes from a Muslim family, but later became an atheist and is openly critical of fundamentalism and religious intolerance. This year, he had a frightening experience. “Some unknown people, who introduced themselves as members of ‘Allah’s Army’, stopped me on the way of returning home from the office, and threatened to kill me with my wife and sons,” he told me via email. “They told me that now it is my turn to be killed and also threatened to kill my wife for being my accomplice, and my sons for being brought up without a religious view.”
Sanyal did not go to the police. He feared outing himself and losing his job. Moreover, he had no reason to believe that the government would offer him protection.
These fears are well grounded. Mohiuddin, the first blogger attacked with machetes in 2013, was soon afterwards arrested under blasphemy laws, illustrating the double threat of extremist violence and official repression. He remained in Dhaka for some time, but conditions were difficult. He covered his face with a mask when he left the house, fearing vigilante attack or arrest. He now lives in Germany and told me that he still regularly receives death threats. “It’s very normal for me.”
Sanyal has also left Bangladesh but his family remains in the country. He asked Index on Censorship not to mention his destination as he still has safety concerns. Bangladeshi fundamentalists recently published an international hit list, including citizens of America and Europe. The clear implication is that nowhere is safe.
One blogger, Nastiker Dharmakatha, wrote a widely circulated document in July explaining the dire situation faced by those who remain in Bangladesh despite being on the hit list. “Since the killing of Ananta Bijoy Das, most of us have been keeping ourselves caged in four walls,” he wrote. “Being the main earning members of our families, we have to go to office regularly. Some of us can’t even avoid evening or night duty at work.”
The letter goes on to explain that the damage inflicted on bloggers isn’t just physical but also mental. With bedroom murders not uncommon, “even staying home fails to guarantee our safety”. Police officers can enter a home at any time to arrest bloggers for “provocative writings”.
After the most recent attacks on publishers, there have been protests in Bangladesh at the continued killings and perceived impunity for the killers. The home minister Asaduzzaman Khan Kamal did nothing to allay the sense that the government is not taking action, telling reporters: “The law-order situation is good. These sorts of stray incidents occur in all countries.”
Such sentiments offer little comfort to those facing a continued and serious threats to their life.

The fund will contribute towards Index on Censorship’s Freedom of Expression Awards Fellowship, a year-long programme to support those facing censorship.

When we founded Freemuse ten years ago, our aim was to defend freedom of expression for musicians and composers. Since then, we have documented music censorship in more than 100 countries. At first, we were not aware of the size of the problem, but the longer we have worked in the field, the larger the challenges become. Maybe we are still only seeing the tip of the iceberg. While more journalists have got music censorship on their radar and a number of musicians have benefited from our support, it is still rare to find records of music censorship and violations of musicians’ rights to freedom of expression in reports from Amnesty, Human Rights Watch and other global free expression watchdogs.

Along with misogyny, homophobic lyrics have long blighted some rap and reggae music. Eminem and Buju Banton, among others, have found themselves in the firing line for their incendiary anti-gay hate music, ranging from rap songs containing insults like “faggot” to tracks that overtly glorify and encourage the murder of lesbian, gay, bisexual and transgender people.
Homophobic hate speech is wrong, regardless of whether it is expressed by a bully in the street or by a singer.

“My life has changed totally since the war,” says 20-year-old Ermin. He speaks of “the constant presence of death” with resignation. “I live shoulder to shoulder with death. Every time I go out, a missile could kill or wound me. Lots of my friends are dead. I think of them every day and 1 know 1 could join them at any moment. I’ve learned to live with this fear for three years now; there was no choice. I know it’s changed me. I’m harder, braver – or maybe I’ve just gone mad. Everybody here’s changed: everybody’s gone mad. You can’t help it after three years shut up in this hell.”

In the summer of 1977 I was 15 years old and wore an old tropical linen jacket I’d bought in a charity shop for a quid. It wasn’t so much off-white as ruinous, and it matched the colour of my shoes – winkle-pickers I’d painted myself using some kind of weird leather paint. Naturally I had to lie on my skinny rump to force my El Greco feet through the eight-inch ankles of my drainpipe jeans. Given all this sartorial mayhem it goes without saying that I absolutely concurred with the Sex Pistol’s front man, Johnny Rotten, when he sang, “God save the queen / The fascist regime”. Admittedly the causal connective “it’s” was lost in all the filth and the fury of his delivery, but we knew what he meant.
Actually, I can barely remember the circumstantial pomp that went into the celebration of the Queen’s Silver Jubilee, all I can recall is the Sex Pistols’ treasonable ditty, and the fact that it was banned from being played on the radio. At least I’m certain it was banned from the BBC’s Radio 1.

In the 1920s, Weimar Germany was home to a rich and diverse mix of artistic and political movements. Composers stretched the boundaries of, and in some cases charted new courses for, classical music. Zeitmusik (music of the time), the 12 tone system and jazz were part of a new and excitingly diverse web of musical movements. As Hitler and the Nazi Party assumed control of Germany, the arts and the political climate were affected. Under the Nazi dictatorship, the arts – particularly music – were used as tools for indoctrinating and controlling the German nation with an ideology of national superiority, suppression and racial hatred.

About the song, McCartney has said: “When you talk about a hole in the ozone layer, you don’t talk about a flipping hole in the ozone layer, you talk about a fucking hole in the ozone layer. I know it might upset some of my fans, but I’m an artist, and I’m 50 years old and I think I can say what I like.”

“Why should music be censorable?” asks Yehudi Menuhin on another page. Elsewhere in this issue the reader will see that in some parts of the world even certain musical instruments can be declared taboo by this or that military dictatorship. In Czechoslovakia since the early seventies it has been chiefly rock music that arouses the ire of the authorities – and those who insist on playing it find themselves not just banned but imprisoned.
Ah, but of course, one might say: if you set out to be a protest singer in a society ruled by a one-party dictatorship, what do you expect? The trouble with that line of argument is that The Plastic People of the Universe and the other rock groups with similarly strange names were not protest singers at all.

It was in the first half of the 1990s that White Noise music became the symbol of the growing racist subculture around Europe. Between 1990 and 1995, the music industry, then in a period of rapid expansion, gradually replaced the badly copied tapes, records that were hard to come by and roughly photocopied magazines with professionally produced CDs. The number of CDs on the market grew steadily; production became increasingly professional with Swedish White Noise record labels among the world’s most active producers.
By 1996, the first phase was over; for the next two years, production maintained its levels but there was no significant increase. By 1999, however, it was once more on the rise, along with white-power magazines, and other propaganda material.

I was first invited to this conference to participate, together with the Uruguayan writer Eduardo Galeano, in an event in which song and literature would work together, bringing together a man like Galeano, who writes with a pen, with someone like me, who, if you would allow me, writes with a guitar. Later on, the organisers phoned me to ask if I would add some thoughts about exile. I agreed to that, since I have been living in that situation now for eight years and one month. Given the nature of this occasion, I have attended some meetings handicapped by the fact that I do not speak English. For this kind of contribution, I need my mother tongue, Spanish. Today I have the advantage of a translation so I am going to throw out some ideas about the exile in which hundreds of thousands of Uruguayans have been living for eight, nine or even 10 years.

Victor Jara was one of the best-known singers and theatre directors during Salvador Allende’s Popular Unity government in Chile. From 1970 to 1973, Jara sang for the people and put on shows in shanty towns and factories, determined that popular culture should be at the heart of the government’s efforts to take Chile along its ‘path to Socialism’.
Shortly after the military coup led by General Augusto Pinochet on 11 September 1973, Victor Jara was taken prisoner. With hundreds of other suspects, he was held in the Chile stadium in the capital, Santiago. He was last seen alive as he was being transferred from there to the National Stadium on 15 September 1973.

Zulkiflee Anwar Haque, aka Zunar, is a Malaysian political cartoonist who has been repeatedly targeted by authorities on account of his work. Five of his cartoon books have been banned by the Malaysian government for allegedly carrying content “detrimental to public order” and thousands confiscated in an effort to curtail freedom of expression.
Zunar told an audience gathered at the Amnesty International Human Rights Action Centre about his battle against corruption through his work as a cartoonist.
The International Press Institute (IPI) released a report on the Joint International Emergency Press Freedom Mission to Turkey undertaken last week by a broad coalition of international free expression and press freedom groups.
The report builds on mission participants’ finding that escalating pressure on media in the period between parliamentary elections in June and repeat polls set for Sunday has significantly impacted journalists’ ability to report on matters of public interest and is likely to “have a significant, negative impact on the ability of voters in Turkey to share and receive necessary information, with a corresponding effect on Turkey’s democracy”.
It does so through 10 brief chapters by mission participants that set forth details on main areas of concern that the participants identified in a joint declaration last week following the close of the mission. The report also contains an evaluation of the degree to which authorities in Turkey have heeded recommendations that IPI set forth six months ago in its report, “Democracy at Risk, IPI Special Report on Turkey, 2015”, concluding that authorities have largely failed to take necessary steps to remedy ongoing threats to media freedom.
“Pressure on media has continued to increase following our mission and we remain extremely concerned about the deteriorating state of press freedom in Turkey and its impact both on the Nov. 1 elections and beyond,” IPI Director of Advocacy and Communications Steven M. Ellis said. “We again call for an immediate end to all efforts to hinder or prevent journalists from giving voters in Turkey the information they need to make an informed decision about their future.”
From Oct. 19 to 21, mission participants met in Istanbul and Ankara with journalists, political representatives and foreign diplomats to demonstrate solidarity with their colleagues in the news media in Turkey and to focus attention in Turkey and abroad on the impact the growing pressure on independent media is likely to have on the Nov. 1 election.
The unprecedented mission brought together representatives from eight leading international press freedom and free expression groups, including IPI, the Committee to Protect Journalists (CPJ), Reporters Without Borders (RSF), the International Federation of Journalists (IFJ), the European Federation of Journalists (EFJ), Article 19, Index on Censorship and the Ethical Journalism Network. Delegates were also joined by members of the Journalists Union of Turkey (TGS) and IPI’s National Committee in Turkey.
Vincent Bolloré is known for business takeovers. Now 63, he has built an empire in energy, agriculture, transport and logistics.
The billionaire is also a media mogul with expanding interests. His investment group Bolloré, named for its president and CEO, has a majority share in Havas, a leading French advertising and PR group. It owns the cable television channel D8 and the daily newspaper Direct Matin.
Bolloré was appointed as president of Vivendi, the French mass media company, in June 2014. Vivendi owns Canal Plus, a French subscription-based television channel known for its irreverent tone, where Bolloré became chairman last September.
A common theme is emerging in Bolloré’s professional life. As he attains more media companies, there are increasing attacks on editorial content he disapproves of. Last June, Le Canard Enchaîné revealed that Havas, a French multinational advertising and public relations company, which is controlled by the Bolloré group, had cut the advertising budget in Le Monde by €3.2 million in 2014 and €4 million in 2015. This followed the publication of two articles that Bolloré disliked — a personal profile and a report on the activities of the Bolloré group in the Ivory Coast.
“It can be hard to understand whether a media owner is doing something to improve the health of his business or whether he is meddling with editorial content,” says Virginie Marquet, a lawyer who specialises in freedom of the press and co-founder of the collective Informer N’est Pas Un Délit (To Inform Is Not A Crime). “What’s new with Bolloré is the brutality of what is taking place.”
Pierre Siankowski is the former culture editor for Le Grand Journal, a primetime talk show which was broadcast on Canal Plus every weekday and produced by independent production company KM. On 3 July, he found himself out of a job when Bolloré personally decided KM would stop producing the talk show. “The reason given is that the show was too expensive and that Bolloré wanted it to be produced internally,” Siankowski says. “But there’s actually an article in Le Parisien that claims the current cost of production is roughly the same.”
For Siankowski, there may be another reason. He says Renaud Le Van Kim, producer of Le Grand Journal, who is believed to have been made to leave the company he created at Bolloré’s demand, and Rodolphe Belmer, former director of Canal Plus who was fired in July, had both expressed support for Les Guignols De L’info — a satirical news bulletin broadcast on Canal Plus where politicians are played by latex puppets — amid rumours the show was under threat.
The puppets are currently in the closet, having been temporarily taken off the air. The show is due to return in November, but on Bolloré’s orders, it will have more of an international focus, and therefore less coverage of French politics. It may also lose its prime-time slot.
Does Siankowski think the attack against Les Guignols might be politically motivated? Is it a gift from Bolloré to Nicolas Sarkozy, who was a frequent target of the show? “Here is what we know: after he got elected, Sarkozy went on holiday on Bolloré’s yacht,” he says. “We also know Sarkozy hated Les Guignols, and that in a few months’ time the political campaign for the presidential election will start.”
Meanwhile at Canal Plus, there were other worrying signs. In July, it was revealed that a documentary on tax evasion at the Crédit Mutuel bank — one of the main financial partners of the Bolloré group — which was scheduled to be broadcast on Canal Plus in May, had been removed from the programme before it was supposed to air. Geoffrey Livolsi, co-director of the documentary, said Belmer had received a phone call from Bolloré, who requested it be axed following a conversation with Michel Lucas, CEO of Crédit Mutuel.
When asked by staff representatives to explain the decision, Bolloré allegedly replied: “You don’t kill your friends.”
The documentary was finally shown on France 3 in October.
In September,another documentary, this time on the rivalry between Sarkozy and French President Francois Hollande, was taken off Canal Plus grid without explanation, before reappearing a month later.
“What this shows is that we don’t have the tools that are needed to protect press freedom,” Marquet says. “This is why we felt we need to mobilise.”
“What we would like to see are sanctions,” Marquet adds, reminding us of the existence of a resolution voted in 2013 by the European Parliament. It states: “Governments have the primary responsibility of guaranteeing and protecting freedom of the press and the media” and considers “the trend of concentrated media ownership in large conglomerates to be a threat to media freedom and pluralism”.
Bolloré’s attack on the media isn’t confined to those organisations in which he has an influence. He has taken legal action against journalists and publications to defend his business interests. His group has sued, among others, rue89, France Inter, Libération and Bastamag. It also took journalist Benoît Collombat to court over an investigation he had done on the group’s activities in Cameroon.
Asked what he thought of “the Canal Plus spirit” on 12 February on France Inter, Bolloré replied: “It’s a spirit of discovery, of openness, sometimes of excessive derision.” On that same evening, Les Guignols featured Bolloré’s puppet, who was asked to define what “acceptable derision” means. It seems the real life billionaire’s answer to that question has been clear.

One of the truly great things about being a student used to be the exposure university life gave you to all sorts of views — absurd and otherwise — and being able to decide for yourself what to make of them. Students were once known for their dedication to free speech and academic freedom, epitomised by the Free Speech Movement at the University of California, Berkeley, 1964-65.
In 2015, students are more renowned for the practice of trying to ban anyone they believe to have dangerous views in order to protect fellow tutees, whether it’s removing the Sun from the shelves or refusing airplay to Robin Thicke’s Blurred Lines. We witnessed this tendency most recently with the petition to ban Germaine Greer from speaking at Cardiff University because of her “misogynistic views towards trans women”.
Index on Censorship chairman David Aaronovitch appeared on BBC Newsnight on Thursday to debate free speech at universities with Toke Dahler, a representative of Leeds University student union. Dahler said that “it’s up to students” to decide where the threat lies, and it is the student union’s responsibility to then “make sure that students feel safe and feel welcome”.
For Aaronovitch, student unions should be places of lively debate and discussion, rather than places where students are “hermetically sealed away behind a form of intellectual rampart within which they can feel safe”. The problem with Dahler’s view, said Aaronovitch, is one of definition. What do we mean by safe? Who exactly feels unsafe? And what do they feel unsafe from?
