Croatia has more work to do on free expression

300_Flag_of_CroatiaAt the stroke of midnight on Sunday, Croatia officially became the 28th member of the European Union. Croatia will be a “serious, responsible and active member”, said President Ivo Josipovic as he ushered in “the first day of our European future”. But threats to freedom of expression, especially in the media, remain.

While the 2012 accession referendum was passed with the lowest ever turnout in a prospective member state, and enthusiasm has since waned further, today is a momentous occasion for a country that was at war only two decades ago – and still grapples with the aftermath. However, with the European Commission regarding freedom of expression a ‘key indicator’ for a country’s readiness to join the union, we should acknowledge that while Croatia has taken some important steps forward, there is work left to do.

The constitution guarantees freedom of expression and the press, and Croatia has recently seen a modest increase in its Freedom House global press freedom ranking, from 78 in 2009, to 64 this year. However, this comes after a significant tumble from 41 in 2007. Croatian journalists, especially those covering war crimes, organised crime and corruption, face continued threats to their well-being and livelihoods.

OSCE media freedom representative, Dunja Mijatovic has repeatedly expressed concerns about public broadcaster HRTs apparent practice of silencing critical journalists. Most recently, in March this year, journalists Denis Latin, Katja Kusec and Ruzica Renic were fired from HRT in suspicious circumstances.

In 2008, Ivo Pukanic, a journalist covering organised crime, intelligence and war profiteering was killed by a car bomb outside his office. It was the third attempt on his life, and also killed his associate Niko Franjic. Six men were convicted for the murders in 2010, but it is still unknown who commissioned the assassination.

This is far from the only attack on Croatian media. In 2007, journalist Zalko Peratovic was detained and his house searched for violating state secrets after publishing a story on war crimes on his blog. Owner of Nova TV, Ivan Caleta, and former media mogul Miroslav Kutle, have both been shot at. Ninoslav Pavic, co-owner of Croatia’s biggest publishing house had his car bombed. Andrej Maksimovic, editor of OTV, has been attacked twice. This handful of examples goes some way in explaining the overall environment of fear and intimidation that has chilled press freedom and consequently freedom of expression in Croatia.

But challenges to freedom of expression exist outside of the realm of the media too. While prison sentences for defamation were abolished in 2006, libel is a criminal offense punishable by fines. Given the country’s recent history, hate speech  is not taken lightly. Hate speech based on race, religion, sexual orientation, nationality, ethnicity, or unspecified ‘other characteristics’ are punishable by up to five years in prison — three years if committed over the internet. Insulting ‘the Republic of Croatia, its flag, coat of arms or national anthem’ can bring up to three years in prison.

Unlike neighbouring countries Croatia has not banned gay pride parades, but freedom of assembly for Croatia’s LGBT population has still be under threat. When a parade was organised for the first time in Split in 2011, the small number of participants were pelted with eggs and rocks by thousands of counter-protesters. The police also failed to investigate an attack on six young men and women in the aftermath of the parade. Authorities have also come under fire for failure to investigate persistent acts of vandalism aimed at the country’s minority Serbian Orthodox community.

Despite this, some aspects of freedom of expression have improved recently. This year’s Zagreb pride parade saw its biggest turnout ever, as 15,000 people attended the peaceful march. In another positive development, this February, parliament adopted a Freedom of Information Act. A new body will be set up, specifically dedicated to freedom of expression, with greater focus on public interest and proactive publishing of information.

Croatian leaders and EU politicians have taken pains to stress that accession does not automatically solve the country’s problems. While they were largely referring to the economic situation, the same principle goes for freedom of expression. You only have to look to EU members like Hungary to see that membership alone does not necessarily improve media freedom. For Croatia, as with other recent additions to the union, membership is merely an initial, tentative step towards increased political and civil rights for its citizens.

 

Bosnians protest as political row leads to infant death

In the shadow of events in Turkey and Brazil, Bosnians have been taking to the streets. For over a week, citizens of the small Balkan country have been protesting their leaders’ failure to pass a new law on citizen identification numbers, leaving babies unable to travel for medical care. Milana Knezevic writes

As is often the case in Bosnia, this seemingly straightforward task soon took on an ethnic element. Serbian parliamentarians wanted the number to recognize the internal geographic split between the Serb majority entity Republika Srpska and the the Croat Bosniak majority Bosnian Federation. Their Croat and Bosniak counterparts disagree.

The political stalemate means that since February newborns in Bosnia have not been able to get passports.

Last Wednesday, activists organised a car blockade of parliament in Sarajevo. The impromptu show of support for Belmina Ibrisevic, a seriously ill infant who could not travel abroad to get treatment, quickly grew until several thousand people surrounded the building, trapping parliamentarians inside.

“It [the protest] is about those few brave citizens who decided to take a risk and react. Others came, following basic instinct and their conscience”, says Sarajevo-based activist and political commentator Nedim Jahic.

On Monday, the leaderless “babylution” took the shape of a tribute to baby Berina Hamidovic, who died at a hospital in Belgrade. After weeks of pleading with authorities, her parents decided to take her across the border without a passport.

“My Berina has died, because to Bosnian authorities she wasn’t alive”, father Emir told local press.

On Tuesday, some of Bosnia’s biggest music acts stepped onto a makeshift stage outside parliament. Behind them, projected onto the parliament building, loomed the image of a giant pacifier in the shape of defiant fist. It is estimated some 10,000 people gathered to see the show. Meanwhile, citizens of Tuzla, Mostar, and other cities have also organised demonstrations under the banner of “JMBG”, the name of the ID law. The official facebook page has 22,000 likes and counting, where photos, videos and articles are widely shared. People from across the world have tweeted and facebooked messages of support, as have some of the biggest stars of the region. Combined, this makes for a remarkable, country-wide wave of political expression not seen for years.

This is not the only time Bosnia’s leaders have been unwilling and unable to make important decisions. The complex system of ethnicity-based quotas and vetoes implemented with the 1995 Dayton peace agreement to accommodate Bosniak, Croat and Serb leaders, has led to political paralysis on a number of occasions.

“The timing was important was an important reason for people reacting the way they have in this particular case”, explains Florian Bieber, Professor in South East European Studies at the University of Graz, and a leading expert on post-war Bosnia. “Frustration had been accumulating over time, especially with the deteriorating economic situation. This is an issue that affects everyone, not only one group, which helped galvanised support across the population. It also has a human face. It’s not about losing money; it’s about lack of ID numbers risking children’s lives”.

The size and scope of the protests is not to be underestimated. The feeling of unity invites comparisons to the anti-war protests of 1992. Much has particularly been made of seemingly cross-ethnic nature of the demonstrations. But while it is certainly the case that Serbs, Croats and Bosniaks alike have been taking part and expressing solidarity, the movement has largely been confined to the Bosnian Federation. Recent student protests in Banja Luka, while likely inspired by the nationwide atmosphere of protest, have distanced themselves from the message of JMBG.

“Today’s protests are also important, however, without significant number of citizens from Republika Srpska, it is hard to expect real change. In todays’ conditions and political structure of Bosnia and Herzegovina, you cannot expect to have change and efficient pressure without relevant support coming from both entities, which is rarely the case”, Jahic concedes.

Politicians have also been unwilling to cooperate thus far. Some parliamentarians have refused to come back to work citing security fears, while Bakir Izetbegovic, the Bosnian representative to the three-member presidency, has urged people not to take to the streets.

Despite this, the movement rumbles on. The protesters have given the politicians a deadline of 30th June to resolve the ID number debacle, and Jahic says the first priority is to “see results on the directly addressed issue.” However, protesters have also demanded that politicians, who earn approximately six times the national average, take a 30% wage cut and place the money in a fund for Bosnians who need medical treatment abroad. This appears to invoke the frustration and anger about the general state of the country helping drive the scale of the protests.

While Bieber is uncertain whether the demands will be met and the elites will change their ways, he does believe this could be a turning point for the country.

“Even if they fail, the protests have made citizens feel they can achieve something”.

All over the world today, both in developing and developed states, liberal democracies and less free societies, there are groups who struggle to gain full access to freedom of expression for a wide range of reasons including poverty, discrimination and cultural pressures. While attention is often, rightly, focused on the damaging impact discrimination or poverty can have on people’s lives, the impact such problems have on free expression is less rarely addressed.

We are not talking about the classic examples of challenges to freedom of expression where repressive regimes attempt to block, limit and inhibit across a population as a whole. Rather we are looking at cases where in both more and less free societies particular groups face greater barriers to free expression than the wider population. Such groups can often be denied an equal voice, and active and meaningful participation in political processes and wider society. Poverty, discrimination, legal barriers, cultural restrictions, religious customs and other barriers can directly or indirectly block the voices of the already marginalised. How much do these barriers and lack of access to freedom of expression matter? A lot – as the examples below tell us.

Why is access to freedom of expression important? Freedom of expression is a fundamental human right. It also underpins most other rights and allows them to flourish. The right to speak your mind freely on important issues in society, access information and hold the powers that be to account, plays a vital role in the healthy development process of any society.

The lack of access to freedom of expression is a problem that particularly affects the already marginalised – that is, minorities facing discrimination both in developed and developing countries, from LGBT people in African countries, to disabled people in Western Europe. While the scale of their struggles varies greatly, the principle is the same: within the context of their society, these groups face greater barriers to freedom of expression than the majority. If they are unable to communicate their ideas, views, worries and needs effectively, means they are often excluded from meaningful participation in society, and from the opportunity to better their own circumstances. In other words, discrimination is one of the core elements of unequal access to freedom of expression.

Access to free expression is also vital both to support the development process and as a development goal in its own right. The connection was perhaps most famously put forward by Amartya Sen in his widely cited book — Development as Freedom — where he argued that expansion of freedom is both the primary end and the principal means of development

It is striking to note the way in which cultural and religious customs are sometimes used to clamp down on various minorities’ rights to expression and assembly in many countries around the world. Human Rights Watch’s latest world report states that “traditional values are often deployed as an excuse to undermine human rights.” One example of this is the caste system still in place in countries including India, Nepal and Pakistan. This is culturally-based discrimination on a major, systematic scale. A significant proportion of the Dalits, (lower-caste people, or “untouchables”) are barred from participation in public life and have a limited say in policies that directly affect them. In May 2008, the Dalit community in the Nesda village in the state of Gujarat attempted to stage a protest after being excluded from the government’s development funds allocation, by refusing to fulfil their historic “caste duty” of disposing of dead animals. The dominant caste in the region promptly blocked the protest through a ‘social boycott’, forbidding any social or economic interaction between Dalits and non-Dalits. This is only one example of Dalit’s being barred from having a say in development matters directly relating to them. When they attempted to stage a peaceful protest, they were only further marginalised, and their weak economic, social and political position further cemented. It’s a vicious cycle.

They are discriminated against for traditional, especially religious, reasons, with countries like Malaysia and Jamaica claiming that homosexuality is simply “not in our culture” when clamping down on LGBT civil rights. The right to express one’s sexuality is an aspect of the right to freedom of expression both in itself (as an expression of identity) but also because in countries where LGBT rights are not respected, the cultural expression of such rights is often also a political act. Cultural events organised by the LGBT community, such as pride parades, find themselves banned from exercising their right to freedom of assembly and expression, which happened last October in Serbia and Moldova. LGBT-themed art is also often times censored. One example reported by Index took place in Uganda, where a play about a gay man was banned, and its British producer, David Cecil, jailed and later deported. Countries also adopt laws that ban or circumscribe the discussion of homosexualty. In Russia, the Duma recently voted in favor of a draft law to ban “homosexual propaganda”. The amendment, passed by an overwhelming majority, prohibits the “propaganda of homosexuality” (in a practical sense, the discussion of homosexually) to protect children. The bill would in effect seriously curtail the right to freedom of expression of LGBT people.

Full access to freedom of expression is difficult to achieve in the absence of universal education and literacy. Around the world, illiteracy and inadequate (or non-existent) education hits the poorest hardest – both because education is often private, and because in poor countries where it is provided by the state, the standard of education can be low. Women and girls in the developing world are the groups most affected by illiteracy. There are a number of factors contributing to this, including higher levels of poverty among women, with culture and tradition also playing a significant part. There are still a number of societies around the world where it simply is not accepted that girls should receive education at all, and certainly not higher education. While the gender gap in education has been decreasing over time, in 2009, there were still around 35 million girls out of primary education, compared to 31 million boys. Lack of education is still the single biggest contributing factor to high and persistent levels of illiteracy — making it the most basic barrier to freedom of expression. It stops people from effectively participating in society, as it hinders them from being able to read, write and share written information, and thus fully engage with a range of issues or debates. Women make up the majority (64 per cent) of the nearly 800 million illiterate people in the world today. UNHCHR resolution 2003/42 identified this as a contributing factor to constraints on women’s rights to freedom of expression.

As well as the impact of poverty, discrimination and religious and cultural factors, governments and local authorities often put in place more formal mechanisms which result in significant restrictions on access to freedom of expression for minority groups. This can come in the form of restrictions on minority languages, such as Kurdish in Turkey, or barriers to political participation, such as the Bosnian constitutional ban on Jews and Roma running for high office.

Refugees are one of the hardest hit groups of people in terms of facing significant and basic restrictions on freedom of expression. A report by the UN High Commissioner for Refugees on the political rights of refugees stated that they, “…like other aliens, are entitled to the same freedom of expression, association and assembly as citizens.” However, a 2005 report investigating the state of Italian immigration detention centres showed that those detained in Italy were given few opportunities for communication with the outside world. Similarly, allegations of arbitrary deprivation of liberty in Greek detention centres are to be examined by independent experts selected by the UN Human Rights Council later this year. These are only a few examples of fundamental barriers on refugees’ access to fully express themselves. This, of course, cannot be separated from the wider discrimination as outlined above. Refugees constitute a group which often face prejudice and racism. Research from Cardiff University has for instance shown that they do not have the platform to counter the overwhelmingly negative way in which they are portrayed in the UK media. Refugees have universal rights like all other people around the world — states must recognise this and must act to tackle discrimination in all forms.

The barriers to free expression discussed here show why exercising our right to free expression is not as simple as living in a democratic society that broadly respects rights. Barriers that block or inhibit access to freedom of expression exist all over the world, in various forms and to varying degrees.
