The silencing of media in times of war

Israel’s High Court of Justice this week heard a petition challenging new legislation allowing a ban on foreign broadcasters deemed a threat to national security.

Known as the Al Jazeera law, in honour of its inaugural target, this allows the communications minister, with the consent of the prime minister and the committee of national security, to impose far-reaching sanctions.

“There is no doubt that there is a violation of freedom of expression here,” the High Court panel’s head, Justice Yitzhak Amit, told the hearing.

Yet Israel’s May shuttering of Al Jazeera – described as a “terror channel” by Prime Minister Benjamin Netanyahu – passed without much domestic concern.

Any outrage was limited to Israel’s small liberal left wing, even though in banning Al Jazeera, Israel joins the august ranks of countries including Saudi Arabia, Egypt and Bahrain.

The issue is, of course, rife with politicisation. Al Jazeera is headquartered in Qatar, as is part of the Hamas leadership, and is hardly free from bias. Nonetheless, this law can be used in the future to ban other foreign broadcasters that are deemed to pose an amorphous “threat to national security”.

And crucially, it includes an “override clause” that even Israel’s high court cannot overturn.

It’s important to note that countries often introduce special legislation affecting media in times of war and crisis, amid legitimate national security considerations.

Ukraine is an obvious case in point, not least because it faces such a particularly sharp threat from Russian disinformation.

A year before Russia’s full-scale invasion in February 2022, President Volodymyr Zelensky moved to shut down three pro-Russian TV channels judged to effectively be weapons in Russia’s information war.

Immediately after the full-scale invasion, all national news channels were united into a 24-hour broadcast, and a subsequent newly revised media law was intended to be muscular enough to withstand Russian malign influence.

Yet while criticism of the government in times of war – especially one being fought with a citizen’s army – is not easy, Ukrainian journalists have quite effectively held their leaders to account.

Reporting on corruption in the defence ministry, for instance, heralded the minister’s resignation of defence minister Oleskiy Reznikov and government pledges for greater transparency.

And critically, the Government’s moves in the information sphere have not gone unchallenged. Ukraine, with its history of authoritarian government and a media scene under the sway of oligarchs and political interests, knows all too well how fragile free expression can be.

While officials made clear that the telethon would be completely free of government intervention, not all outlets were included, and critics note that some of those excluded such as Espresso, Channel 5, and Priamyi, had often criticised Zelensky and to varying degrees were associated with his predecessor Petro Poroshenko.

And there was widespread criticism of the March 2023 media law for handing too much power to government intervention, with the same measures to counter Russian disinformation all too easily abused to limit critical voices.

In neighbouring Moldova, scores of pro-Russian outlets were banned under the state of emergency declared immediately after Russia’s full-scale invasion of Ukraine.  More than two years later, the TV channels and websites remain blocked despite the end of the state of emergency, and many critics would argue that the country remains as vulnerable as ever to Russian propaganda.

What is needed to ensure that national security considerations do not become a tool to control free expression is a robust civil society push back and an ongoing debate on the boundary between freedom of speech and the fight against fake news.

In Israel, where the national narrative has become an inextricable part of the conflict itself, the public appears increasingly supine in the face of the official version of events.

Israel has long championed its diverse and outspoken media sector as a sign of a vibrant democracy, alongside robust laws that purport to protect free expression. But civil society and media are now experiencing repression from both official and non-state sources, with Palestinian citizens of Israel bearing the brunt.

Anti-war protests have been curtailed and violently repressed; Jewish and Arab teachers fired over left-wing posts on social media, while students have faced disciplinary actions for simply supporting a ceasefire.

Dissenting voices and journalists are being directly targeted and doxxed. Just after 7 October, Communications Minister Shlomo Karhi suggested police be empowered to arrest those accused of spreading information that could harm morale or fuel enemy propaganda.

Haaretz journalist Rogel Alpher this week noted a column in Yisrael Hayom which called for articles in the penal law that mandate execution or life imprisonment enforced on those disseminating “defeatist propaganda” or “abetting the enemy”.

Of course, Israel is not about to start executing journalists. The vast majority of extreme proposals do not make it into law, just as most anti-war arrests do not lead to indictments. Even bans on specific outlets are not total; Al Jazeera can still be accessed with absolute ease online.

But this all helps create a chilling atmosphere, serving to normalise such actions and increasing self-censorship.

Israel’s Hebrew-language media has chosen to self-censor to such a large extent that Jewish Israelis experience what Esther Solomon, editor-in-chief of Haaretz English, describes as a  “cognitive gap” between the content they consume and what the rest of the world sees.

This means that anything confronting the profoundly uncomfortable reality of war and contradicting the accepted IDF narrative is seen as traitorous and a threat to national security.

The public acceptance of vaguely worded censorious media laws seems to fit all too well with the ongoing slow and creeping deterioration of Israel’s democracy.

Are people in Israel getting the full story on Gaza?

Israel’s decision to seize video equipment from AP journalists last week may have been swiftly reversed but the overall direction of travel for media freedom in Israel is negative.

Journalists inside Gaza are of course paying the highest price (yesterday preliminary investigations by CPJ showed at least 107 journalists and media workers were among the more than 37,000 killed since the Israel-Gaza war began) and it feels odd to speak of equipment seizures when so many of those covering the war in the Strip have paid with their lives. But this is not to compare, merely to illuminate.

The past few days have provided ample evidence of what many within Israel have long feared – that the offensive in Gaza is not being reported on fully in Israel itself. On Tuesday a video went viral of an Israeli woman responding with outrage at the wide gulf between news on Sunday’s bombing of a refugee camp in Rafah within Israeli media compared to major international news outlets. Yesterday, in an interview with Canadian broadcaster CBC, press freedom director for the Union of Journalists in Israel, Anat Saragusti, spoke more broadly of the reporting discrepancies since 7 October:

“The world sees a completely different war from the Israeli audience. This is very disturbing.”

Saragusti added that part of this is because the population is still processing the horrors of 7 October and with that comes a degree of self-censorship from those within the media. The other reason, she said, is that the IDF provides much of the material that appears in Israeli media and this is subject to review by military censors. While the military has always exerted control (Israeli law requires journalists to submit any article dealing with “security issues” to the military censor for review prior to publication), this pressure has intensified since the war, as the magazine +972 showed. Since 2011 +972 have released an annual report looking at the scale of bans by the military censor. In their latest report, released last week and published on our site with permission, they highlighted how in 2023 more than 600 articles by Israeli media outlets were barred, which was the most since their tracking began.

In a visually arresting move, Israeli paper Haaretz published an article on Wednesday with blacked out words and sentences. Highlighting such redactions is incidentally against the law and will no doubt add to the government’s wrath at Haaretz (late last year they threatened the left-leaning outlet with sanctions over their Gaza war coverage).

The government’s attempts to control the media landscape was already a problem prior to 7 October. Benjamin Netanyahu is known for his fractious relationship with the press and has made some very personal attacks throughout his career, such as this one from 2016, while Shlomo Kahri, the current communications minister, last year expressed a desire to shut down the country’s public broadcaster Kan. This week it was also revealed by Haaretz that two years ago investigative reporter Gur Megiddo was blocked from reporting on how then chief of Mossad had allegedly threatened then ICC prosecutor (the story finally saw daylight on Tuesday). Megiddo said he’d been summoned to meet two officials and threatened. It was “explained that if I published the story I would suffer the consequences and get to know the interrogation rooms of the Israeli security authorities from the inside,” said Megiddo.

Switching to the present, it feels unconscionable that Israelis, for whom the war is a lived reality not just a news story, are being served a light version of its conduct.

In the case of AP, their equipment was confiscated on the premise that it violated a new media law, passed by Israeli parliament in April, which allows the state to shut down foreign media outlets it deems a security threat. It was under this law that Israel also raided and closed Al Jazeera’s offices earlier this month and banned the company’s websites and broadcasts in the country.

Countries have a habit of passing censorious legislation in wartime, the justification being that some media control is important to protect the military. The issue is that such legislation is typically vague, open to abuse by those in power, and doesn’t always come with an expiry date to protect peacetime rights.

“A country like Israel, used to living through intense periods of crisis, is particularly vulnerable to calls for legislation that claims to protect national security by limiting free expression. Populist politicians are often happy to exploit the “rally around the flag” effect,” Daniella Peled, managing editor at the Institute for War and Peace Reporting, told Index.

We voiced our concerns here in terms of Ukraine, which passed a media law within the first year of Russia’s full-scale invasion with very broad implications, and we have concerns with Israel too. But as these examples show, our concerns are far wider than just one law and one incidence of confiscated equipment.

Are we sleepwalking into Orwell’s nightmare?

“We are all born free. We all have our own thoughts and ideas, and we should all be treated the same way.”

These words form the first article of the United Nations Universal Declaration of Human Rights. Adopted on 10 December 1948, the document was created to outline and protect every human’s basic right after the bloodshed of the Second World War.

At the same time, George Orwell was completing his classic dystopian novel, Nineteen Eighty-Four; published the following year. While fictional, it painted a radically different vision: “If you want a picture of the future, imagine a boot stamping on a human face – forever.”

Following a screening of the final programme of BBC Arena’s series about the life of Orwell, aired in 1984, a panel at WoWFEST: FAHRENHEIT 2024 festival in Liverpool discussed the question: Just how close are we to Orwell’s vision – or are we already there?

Daniel Gorman is director of English PEN, one of the first international bodies that advocated for human rights, of which Orwell was a member. He believes the novel is still key when looking at the challenges facing freedom of expression today: “The book is always relevant but feels particularly feels so with the current creep of authoritarianism. It is a warning.

“It says something about human nature more broadly, about state and power, and as more power is centralised in fewer hands, we could go along with it until we realise it’s too late.”

Against the backdrop of a collapsed Nazi Germany regime and a Soviet Iron Curtain falling across Europe, it was clear who the ideological proponents were around the time of Orwell’s writing. Freedom of expression and human rights campaigner and researcher Sara Whyatt stated now, however, the lines are more blurred.

“We still have the usual suspects like Russia, and Belarus is there, plus situations like now in Georgia with the proposed introduction of the ‘foreign agent’ law in the country.

“It becomes very difficult now though now as it’s an amorphous group of people at play. This is where social media also plays a problematic role”, she added.

Historically seen solely through the lens of states and countries, the destabilising effect of social media on the fight against censorship was a key discussion point in the debate.

“I used to know who to send letters to, and which buildings to protest outside of. Now, I don’t know who the enemy is anymore, and I feel the enemy is all around me through social media. Does that feel real?”, Whyatt continued.

Nineteen Eighty-Four is also about the manipulation of communications, seen now through the difficulty to parse through a barrage of information on social media, with bot farms trying to widely sow confusion with misinformation and disinformation, argued Gorman.

He admitted that social media does sometimes have its positives and gets information out when official sources are limited: “The vast majority of information we’re getting from Gaza is from local journalists through social media, as international journalists haven’t been allowed in, and remember its role in the 2011 Arab Spring also. The problem is always there for information to be abused.”

Dolan Cummings is director of the Manifesto Club, an organisation that challenges what it calls the “hyper-regulation” of public spaces. Like the online space, he believes there’s a problem with freedom of speech and expression in the physical world, citing encroaching laws in the UK.

“I think the view in the UK now is that freedom of association and speech are problems to be managed rather than potential solutions to problems. Not just around political protest but also even bans on things like busking and leafleting are criminalised by public spaces protection orders”, he said.

Naturally a debate concerning a novel also covered the role of censorship against creative expression. Gorman relayed what an exiled author told him when asked why he thought he was targeted in his homeland.

“He said words have power and novels last, and when they work right, they can really upset the workings of power and connect the struggles of human rights. I think we see that with Nineteen Eighty-Four.”

Despite the inspiring words, the panel laid bare both the increasing financial and artistic challenges facing creatives’ freedom of expression in 2024. Whyatt, who is an expert on freedom of artistic expression, explained artistic censorship often involves less obvious, underlying issues.

“Worldwide, governments are strategically placing people they want in broadcasting and cultural institutions, who then choose directly where funding goes.

“There is also self-censorship in the arts too. Venues might like an artist’s work but may reject it due to fear of controversy and a stripping of future funding or grants. In that instance, is it pragmatism or censorship?”

Writer and performance poet Francesca Beard read a poem specially inspired by the Arena documentary and told Index about her fear of AI and tools such as ChatGPT. Although she thinks they have some benefits for her profession, people have to be careful with their use in the future.

She said: “I put my questions into it and see what comes out. It’s good for rhyme and rhythm but it’s very superficial and makes me think ‘well I’m not going to write like that’, so it helps in that way.

“We need human, creative thought though. It’s all our individual responsibility to make sure we’re not too satisfied by it, because if we are then in the future, I’m worried that’s all we’ll be served up for our art.”

There is hope for the future and a chance for humanity to avoid sleepwalking into an Orwellian nightmare, Gorman said, but added financial support is desperately needed.

“We have so many people standing up who value freedom of speech and expression, all really supporting each other, but there needs to be strong investment into things such as civil society, investigative journalism and NGOs, so we can all hold the powerful to account.”

Georgia’s foreign agent bill: an existential threat to democracy

As the world looks on in horror at Russia’s aggression in Kharkiv and in despair at events in the Middle East it is easy to miss the detail of what is happening in other countries as political leaders move to censor as the democratic values that we hold increasingly feel under threat. This week we have seen an assassination attempt on the Slovakian Prime Minister and an attempted terror attack in Rouen.

In Georgia, there are protests in the streets of the capital Tbilisi. A fierce battle is being waged, not with weapons, but with voices raised in unison against an outrageous and controversial “foreign agent” law. The legislation, which has already passed its third reading in parliament with a vote of 84 to 30, mandates that NGOs and independent media receiving over 20% of their funding from foreign sources register as entities “bearing the interests of a foreign power”. This bill has sparked widespread protests, with thousands taking to the streets in defiance Geogriof what they see as an existential threat to their democracy and civil liberties.

The comparison to Russia’s 2012 law, which similarly targets foreign-funded organisations and has been used to suppress dissent, is not lost on the Georgian people. Critics aptly nickname the bill the “Russia law,” fearing it could pave the way for authoritarianism in Georgia, much like it did in Russia. The legislation’s draconian measures include potential fines of up to 25,000 GEL ($9,400 or £7,500) and stringent monitoring by the Justice Ministry, raising alarms about the erosion of democratic freedoms.

Protesters, driven by a desire to protect their democratic values and maintain Georgia’s trajectory towards European integration, have clashed with police and faced arrests. The atmosphere in Tbilisi has been charged, with demonstrators attempting to breach the parliament building and shutting down major intersections. Tensions have spilled over into parliament, where physical and verbal altercations between pro-government and opposition MPs underscore the high stakes of this political confrontation.

President Salome Zourabichvili, an outspoken critic of the bill, has vowed to veto it. However, the ruling Georgian Dream party holds sufficient seats in parliament to override her veto, casting doubt on the president’s ability to halt the legislation. Prime Minister Irakli Kobakhidze’s ominous warning that backing down would lead Georgia to “easily share the fate of Ukraine” without further explanation has only fuelled public anxiety.

The international community has not remained silent. The European Union, keenly observing Georgia’s bid for membership, has warned that the bill could jeopardise its candidacy. Roberta Metsola, President of the European Parliament, expressed solidarity with the Georgian people, affirming their right to a European future. Similarly, the White House has cautioned that it would reassess its ties with Georgia, urging the president to veto the law. The UK’s Minister for Europe, Nusrat Ghani, has described the scenes in Georgia as shocking, further highlighting the global implications of this domestic struggle.

Natia Seskuria, a former member of Georgia’s National Security Council, believes the protests will persist as long as the law remains a threat. Indeed, the resilience of the Georgian people is evident. “We are waiting for when we will have a choice to choose a new government,” a young protester told AFP, reflecting a common sentiment among those seeking change in the upcoming parliamentary elections.

The stakes are incredibly high. The new law not only threatens civil society and media freedom but also risks derailing Georgia’s European aspirations. With elections just five months away, the Georgian Dream party’s grip on power is being fiercely contested. The pro-democracy protests in Georgia are a testament to the unyielding spirit of its people, who refuse to let their country slip into authoritarianism. Their struggle is a poignant reminder that the fight for freedom and sovereignty is ongoing and must be vigilantly defended.
