[vc_row][vc_column][vc_single_image image=”116270″ img_size=”full” add_caption=”yes”][vc_column_text]Index on Censorship was founded by writers and scholars, nearly half a century ago, in order to provide a bulwark against censorship. One of our founders, Stephen Spender, stated on our launch that: “The writers and scholars whom one relies on to support (Index) would obviously include those at universities. For the universities represent the developing international consciousness which depends so much on the free interchange of people, and of ideas.”
Which is why we are so intrigued by the Government’s publication of a policy paper outlining their plans to protect free speech and academic freedom on campus in England. Index supports all efforts to protect academic freedom and will work with all stakeholders to protect this core right and while there is much to be applauded in the sentiments outlined, the devil, as always, is in the detail.
The policy paper does touch on one of the most dangerous threats to our collective academic freedom but it doesn’t suggest any policy prescriptions to address the influence of hostile nations in both limiting speech on campus and affecting the curriculum. In recent days, we have seen reports of academics being investigated for breaching national security laws because of their dealings with China. There have been ongoing reports of interference on campus both in terms of the curriculum and the work of student societies. This is where we need a strong government intervention – otherwise these hostile acts will continue unabated.
The Government has outlined seven specific policy proposals ranging from changing the onus on Higher Education providers to be proactive in their defence of academic freedom rather than passive, to the appointment of a Free Speech and Academic Freedom Champion who while working under the auspices of the Office for Students and will have the authority to act as an Ombudsman for complaints related to academic freedom.
Fundamentally the majority of these proposals are actually tweaks to the current legislative framework which already applies to English Universities, with the exception of the new appointment of a Free Speech Champion. In a positive light this could therefore be seen as an effort to simplify the current legal framework in order for people to better understand their rights and therefore they will feel empowered to demand genuine academic freedom.
However, our fear is that this isn’t the case. The Government have recognised that there is a problem on campus which is having a chilling effect in specific specialisms and leading to intolerance rather than debate at some of our academic institutions. This is however a cultural problem and you simply can’t legislate for cultural change – you need the carrot as well as the stick and this is missing from the policy paper.
It is also somewhat Orwellian to appoint a government Champion to determine what is and what is not free speech.
Fundamentally, Index welcomes this renewed commitment to academic freedom and will work with all stakeholders to try and ensure this works – even the new Free Speech Champion… We just wonder if the Government may have been wiser to focus its efforts on ensuring that external pressures from hostile governments were being robustly resisted.[/vc_column_text][/vc_column][/vc_row][vc_row][vc_column][three_column_post title=”You may also want to read” category_id=”8843″][/vc_column][/vc_row]

Whilst many of us have lost loved ones and tried to cope with the impact of lockdowns, social restrictions, closed businesses, redundancies, reduced wages, home schooling and the fear of illness, others have sought to exploit the situation – hoping that the world wouldn’t notice.
Our theme for the winter edition of Index on Censorship magazine was Masked by Covid – the underreported stories of 2020 which had been drowned out by the global public health emergency. There were simply too many for one edition of the magazine.
The news cycle has been dominated by Covid, Trump and Brexit with little else being able to break through. This in itself provided the ideal opportunity for leaders of repressive regimes to move against their citizens with impunity; after all the world wasn’t watching. But when you add the ‘legitimacy’ of emergency regulations to the mix under the guise of protecting the population against Covid, the perfect storm for repression and tyranny has been created.
When the virus spread last spring, Index started covering how it was affecting free speech around the world through a project called Disease Control. Documenting new legislation which closed local newspapers, new regulations which restricted or delayed access to government information, limitations on the free press, the end of the right to protest in numerous countries and arrests of political activists in dozens of countries.
As we all now await to be vaccinated and long for a return to normal, you would hope that maybe the dictators and authoritarian leaders, around the globe, would mitigate their actions knowing that the world might start to pay attention. Unsurprisingly that isn’t proving to be the case.
Only this week we have seen the Polish Government ban abortion, the Greek government propose a new university police force to deal with ‘trouble makers’ on campus and, in Russia, the coronavirus restrictions have been used as a cover to arrest Alexei Navalny’s allies – in the wake of his detention and the subsequent protests.
And it hasn’t just been Covid that has provided cover for oppression. In Turkey, on 27 December – when many of us were more focused on Netflix then the news – the government passed a new piece of anti-terrorism legislation, Preventing Financing of Proliferation of Weapons of Mass Destruction. I think most of us would welcome legislation that sought to stop the proliferation of WMDs.
Whilst this legislation has ostensibly been introduced to meet a United Nations Security Council counterterrorism resolution, unfortunately this new law actually goes well beyond that. It is an unfettered attack on civil society organisations across Turkey – with a clear emphasis on undermining those organisations which seek to protect minorities, especially the Kurdish population.
The legislation enables the Interior Ministry to replace board members of NGOs with state-appointed trustees. They can also suspend all operations and activities of an NGO if members are being prosecuted on terrorism charges – this would seem completely reasonable in many nation states, but as over 300,000 people are arrested for being a member of a terrorist group in Turkey every year, the definition of terrorist isn’t quite the global standard.
The legislation also gives the Governor’s office the right to undertake annual inspections of NGOs adding a new admin burden, international NGOs are also covered by new provisions and unsurprisingly financial assets and online donations to individual campaigns can be blocked by the government to “prevent terrorist financing and money laundering”.
Erdogan has just doubled down as an authoritarian leader and did so without global condemnation or even notice. It simply isn’t good enough…
All of these actions, and the many others from Hong Kong to Uganda, seek to cause division, undermine hope in the domestic population and entrench control. The world is getting smaller, technology means that we can know what is happening, as it happens, in every corner of the world. But too many people have stopped paying attention.
For Index it means that we have to double down and keep finding new ways to tell people’s stories so no one can claim ignorance.[/vc_column_text][/vc_column][/vc_row][vc_row][vc_column][three_column_post title=”You may also want to read” category_id=”41669″][/vc_column][/vc_row]

[vc_row][vc_column][vc_column_text]Index on Censorship CEO Ruth Smeeth added her thoughts to proposed legislation to protect free speech in UK universities.
The legislation known as the Freedom of Speech (Universities) Bill 2019-21, proposed by former Brexit secretary David Davis, had its first reading on 19 January.
According to the UK Parliament website, the bill will “place a duty on universities to promote freedom of speech; to make provision for fining universities that do not comply with that duty; and for connected purposes”.
In the Daily Express, Smeeth said: “Universities are the home of debate and investigation in society and should always be a home for exploring new and controversial ideas. We must ensure free speech exists on campus.”[/vc_column_text][/vc_column][/vc_row]

The realisation of academic freedom typically depends on controversy: it voices dissent. Linked to free speech, it is marked primarily by critique, speaking against – even offending against – prevailing or accepted norms. If it is to be heard, to make a substantial difference, such speech cannot be entirely divorced from rules or law. Yet legitimate rule – law – is itself established through talk, discussion and debate. Academic freedom seeks a new linguistic bond by engaging with or even producing a free assembly of mutually linked speakers. To curb such freedom, you delegitimise certain speakers or forms of speech; and the easiest way to do this is to isolate a speaker from an audience and to isolate members of an audience from each other. Silence the speaker; divide and rule the audience. When that seems extreme, work surreptitiously: attack not what is said but its potentially upsetting or offensive “tone”. Such inhibitions on speech increasingly chill conditions on campus.
Academic freedom is typically enshrined in university statutes, a typical formulation being that “academic staff have freedom within the law to question and test received wisdom, and to put forward new ideas and controversial or unpopular opinions, without placing themselves in jeopardy of losing their jobs or privileges” – as the statutes of the University of Warwick, where I work, have it. Yet academic freedom is now being fundamentally weakened and qualified by legislation, with which universities must comply.
British Prime Minister David Cameron, speaking in Munich on 5 February 2011, said: “We must stop these groups [terrorists] from reaching people in publicly funded institutions like universities.” This was followed by a UK government report on tackling extremism, released ahead of the recent election, which said: “Universities must take seriously their responsibility to deny extremist speakers a platform.” It was suggested that “Prevent co-ordinators” could “give universities access to the information they need to make informed decisions” about who they allowed to speak on campuses. Ahead of May’s UK election university events had already been changed or cancelled. And immediately after the election, the government signalled its intention to focus further on the extremism agenda. In endorsing this approach, university vice-chancellors have acquiesced in a too-intimate identification of the interests of the search for better argument with whatever is stated as government policy. The expectation is that academics will in turn give up the autonomy required to criticise that policy or those who now manage it on government’s behalf in our institutions.
Governments worldwide increasingly assert the legal power to curtail the free speech and freedom of assembly that is axiomatic to the existence of academic freedom. This endangers democracy itself, what John Stuart Mill called “governance by discussion”. The economist Amartya Sen, for example, has recently resigned from his position as chancellor of Nalanda University in India because of what he saw as “political interference in academic matters” whereby “academic governance in India remains … deeply vulnerable to the opinions of the ruling government”. This is notable because it is one extremely rare instance of a university leader taking a stand against government interference in the autonomous governance of universities, autonomy that is crucial to the exercise of speaking freely without jeopardy.
Academic freedom, and the possibilities it offers for democratic assembly in society at large, now operates under the sign of terror. This has empowered governments to proscribe not just terrorist acts but also talk about terror; and governments have identified universities as a primary location for such talk. Clearly closing down a university would be a step too far; but just as effective is to inhibit its operation as the free assembly of dissenting voices. We have recently wit- nessed a tendency to quarantine individuals whose voices don’t comply with governance/ government norms. Psychology professor Ian Parker was suspended by Manchester Metropolitan University and isolated from his students in 2012, charged with “serious misconduct” for sending an email that questioned management. In 2014, I myself was suspended by the University of Warwick, barred from having any contact with colleagues and students, barred from campus, prevented from attending and speaking at a conference on E P Thompson, and more. Why? I was accused of undermining a colleague and asking critical questions of my superiors, the answers to which threatened their supposedly unquestionable authority. None of these charges were later upheld at a university tribunal.
More insidious is the recourse to “courtesy” as a means of preventing some speech from enjoying legitimacy and an audience. Several UK institutions have recently issued “tone of voice” guidelines governing publications. The University of Manchester, for example, says that “tone of voice is the way we express our brand personality in writing”; Plymouth University argues that “by putting the message in the hands of the communicator, it establishes a democracy of words, and opens up new creative possibilities”. These statements should be read in conjunction with the advice given by employment lawyer David Browne, of SGH Martineau (a UK law firm with many university clients). In a blogpost written in July 2014, he argued that high-performing academics with “outspoken opinions”, might damage their university’s brand and in it made comparisons between having strong opinions and the behaviour of footballer Luis Suárez in biting another player during the 2014 World Cup. The blog was later updated to add that its critique only applied to opinions that “fall outside the lawful exercise of academic freedom or freedom of speech more widely”, according to the THES (formerly the Times Higher Education Supplement). Conformity to the brand is now also conformity to a specific tone of voice; and the tone in question is one of supine compliance with ideological norms.
This is increasingly how controversial opinion is managed. If one speaks in a tone that stands out from the brand – if one is independent of government at all – then, by definition, one is in danger of bringing the branded university into disrepute. Worse, such criticism is treated as if it were akin to terrorism-by-voice.
Nothing is more important now than the reassertion of academic freedom as a celebration of diversity of tone, and the attendant possibility of giving offence; otherwise, we become bland magnolia wallpaper blending in with whatever the vested interests in our institutions and our governments call truth.
This vested interest – especially that of the privileged or those in power – now parades as victim, hurt by criticism, which it calls of- fensive disloyalty. What is at issue, however, is not courtesy; rather what is required of us is courtship. As in feudal times, we are legitimised through the patronage of the obsequium that is owed to the overlords in traditional societies.
Academic freedom must reassert itself in the face of this. The real test is not whether we can all agree that some acts, like terrorism, are “barbaric” in their violence; rather, it is whether we can entertain and be hospitable to the voice of the foreigner, of she who thinks – and speaks – differently, and who, in that difference, offers the possibility of making a new audience, new knowledge and, indeed, a new and democratic society, governed by free discussion.
