Turkey’s judicial system: Under the government’s thumb

[vc_row][vc_column][vc_single_image image=”100019″ img_size=”full” add_caption=”yes” alignment=”center”][vc_column_text]In the wake of the 15 July 2016 coup attempt, Turkey has become a “de facto permanent” emergency regime. The state of emergency, which has been extended six times, has become a convenient pretext for the government to crack down on freedom of expression.

The resultant purge has had draconian impacts: 5,822 academics sacked, 189 media outlets shuttered and 319 journalists arrested or prosecuted. The country’s judicial system has been decimated, with 4,560 judges and prosecutors dismissed. The government’s near-complete takeover of the judiciary and its direct defiance of the rule of law has debased freedom of expression in the country.

Examples of how the executive arm of the Turkish government is pulling the strings of the judiciary are not hard to find.

“Public indignation”

On 31 March 2017, the chief judge and two members of the Istanbul 25th High Criminal Court, who ordered the release of 21 journalists, and the prosecutor, who requested the releases, were suspended and later faced a disciplinary hearing. The 21 journalists were kept waiting in a prison van until a new arrest and detention order was issued by another court, which was under an onslaught of attacks from pro-government social media accounts.

Judicial Council deputy president Mehmet Yilmaz explained the reasoning behind the suspension of the judges: “The evidence has not been collected…and the release decision issued…has caused public indignation and harmed public conscience.”

If members of the judiciary can be suspended because their decision has caused “public indignation and harmed public conscience”, this suggests that judges in Turkey are without any protection from external pressures.

In another case, on 31 January 2018, a court ordered the release of Amnesty International’s Turkey chair Taner Kilic, but just hours later another demanded his re-arrest. Amnesty’s secretary general Salil Shetty said: “Over the last 24 hours, we have borne witness to a travesty of justice of spectacular proportions. To have been granted release only to have the door to freedom so callously slammed in his face is devastating for Taner, his family and all who stand for justice in Turkey.”

Taner’s renewed detention came after a decision from the Istanbul trial court to conditionally release him before his trial. However, after the prosecutor appealed, a second court in Istanbul accepted this appeal and quashed Taner’s release.

“I do not know why I was imprisoned a year ago and why I was released”

In another example of government interference, Turkish-German journalist Deniz Yücel, who reported for Die Welt newspaper, was arrested on 27 February 2017 in Istanbul. At the time, Turkey’s president, Recep Tayyip Erdogan, summarised the accusations against Yücel saying: “He is not a correspondent; he is a terrorist. … This person hid in German consulate for a month as a representative of PKK, as a German spy. We have recordings, everything. This is the very spy terrorist.”

Erdogan also reportedly said that Yücel would not be released so long as he was the president. Yücel’s detention continued for almost a year without charge.

On the eve of his official trip to Germany on 15 February 2018, prime minister Binali Yildirim responded to protests and open requests from the German government for Yucel’s release. He said: “I think that a development will take place soon.” In a joint press conference with German chancellor Angela Merkel on 15 February 2018, he said: “What is necessary shall be done within the scope of the rule of law; what is required of us is to clear the way for the courts. … I hope that the trial will take place within a short time and a result will be achieved.”

On 16 February 2018 the Istanbul High Criminal Court accepted an indictment against Yücel that sought an 18-year sentence, yet the court also simultaneously ordered his release. Yücel flew to Germany on the same day. No international travel ban was imposed, despite the high sentence the prosecutor was demanding, which is the regular practice in “terror” related cases.

After his release, Yücel reported that he was given a 13 February 2018 ruling by the Third Criminal Peace Judgeship which detailed an order for his continued detention. “I am free despite this. I do not know why I was imprisoned a year ago and why I was released today. Is it not strange? Anyway, it does not matter. After all, I know that neither my jailing — more precisely my being taken as a hostage a year ago — nor my release today is in accordance with the rule of law at all. I know this very well.”

It’s clear that Yücel’s release and ability to leave the country were the result of political deals and the high criminal court was taking orders from the executive branch of government.

“Attempting to overthrow the constitutional order”

Within hours after Yücel’s release, six other individuals, including five journalists, were issued life sentences for “attempting to overthrow the constitutional order”. Ahmet Altan, Mehmet Altan, Nazli Ilicak, Yakup Şimşek, Fevzi Yazıcı and Şükrü Tuğrul Özsengül were all handed sentences after being convicted of involvement with the attempted coup, despite a clear lack of direct evidence.

“The court decision condemning journalists to aggravated life in prison for their work, without presenting substantial proof of their involvement in the coup attempt or ensuring a fair trial, critically threatens journalism and with it the remnants of freedom of expression and media freedom in Turkey,” said David Kaye, the United Nations special rapporteur on freedom of opinion and expression.

The constitutional court decided on 11 January 2018 that the freedom of expression and liberty of the two journalists Mehmet Altan and Şahin Alpay had been violated. Following the decision, deputy prime minister and government spokesperson Bekir Bozdağ stated on his Twitter account that the constitutional court had overstepped its boundary drawn up by the constitution and legislation. Under pressure from the government, the decisions made in the cases of Alpay and Altan were not implemented by Istanbul courts. This was due to almost the same reasoning as used by the government spokesperson.

Despite the dictum that the court’s decisions are final and binding on the legislative, executive and judicial matters, the courts of the first instance have not implemented the decision.

Another disappointment for the freedom of all arrested journalists

In another case, after an application by journalist Sahin Alpay, the constitutional court delivered the decision on 19 March 2018 that found Alpay’s rights were violated under the European Convention on Human Rights. By contrast, the Istanbul court followed the ruling this time and issued Alpay’s conditional release. Surprisingly, nothing was heard from the executive on this occasion. This development has been regarded by some as the government’s tactical move to avoid a possible European Court of Human Rights ruling on related pending cases to the effect that the constitutional court is not an effective remedy.

Turkish human rights lawyer Kerem Altıparmak tweeted that the Turkish government’s move was intended to send a message to the ECtHR that the constitutional court is a viable domestic remedy. Yaman Akdeniz, another prominent law professor and rights defender, said that ECtHR’s rejection of examination of the cases of journalists relying on the Article 18 of the European Convention on Human Rights is another disappointment for the freedom of all arrested journalists.

“A disgrace to Turkey’s justice system”

On 9 March 2018 a Turkish court sentenced 25 journalists to imprisonment on the grounds of allegedly being members of a terrorist organisation. The prosecutor’s primary evidence was that the journalists had criticised the Turkish government and Erdogan on social media. On these charges, 23 of the accused journalists were given between two and seven years in prison. Nina Ognianova, the Committee to Protect Journalists Europe and Central Asia programme co-ordinator, described the decision as “a disgrace to Turkey’s justice system”. She called on authorities to drop the charges on appeal.

Even before the attempted coup in July 2016, the situation for academics within Turkey was drastically changing.

Marking a turning point for the country’s political environment, the failed July 2016 coup was an attempt to oust president Recep Tayyip Erdogan.

In 2016 hundreds of academics were dismissed from their positions without notice, including sociologist Sharo Ibrahim Garip, who taught at Yuzuncu Yil University in the East Anatolian city of Van, Turkey.

A German national with Kurdish roots, Garip was dismissed from his position at the university in February 2016. Accused of spreading terrorist propaganda, he was arrested in January 2016 and placed under a two-year travel ban, after he signed a petition, along with 1,227 other academics, urging the Turkish government to end its crackdown on Kurdish communities in Turkey’s southeast.

The petition by Academics for Peace called for a peaceful situation to the conflict with the Kurdish Workers Party (PKK), a terrorist group seeking an independent Kurdish state within Turkey. Garip and the other academics denounced “war-like conditions” in the south-east and accused the government of an “extermination and expulsion policy” following the end of a ceasefire with the group and Turkish security forces in 2015. President Erdogan referred to them as “so-called intellectuals” and accused the signatories of “treason”.

Although there was no evidence Garip supported the group, he was still unable to leave the country or practice his profession, although his German citizenship prevented him from being detained pre-trial. Now working at the University of Essen-Duisburg, Garip spoke with Danyaal Yasin of Index on Censorship about his dismissal and the situation for academics following the coup.

Index: After you and hundreds of other academics were dismissed, what were your initial thoughts?

Sharo Ibrahim Garip: I was at the university. I received just a one-sentence decision from the university administration: “Mr Garip’s contract has been cancelled as the university no longer requires his services.” It was not surprising to me because I had already expected such an outcome. The history of the Turkish state is rife with instances of the elimination of political opposition, particularly critical thinkers such as academics and journalists. It was a planned action to eliminate critical thinkers from universities and the public sector. All those changes in the bureaucracy and public sector started before the military coup and continued following the civilian putsch. I could clearly observe the regime change in silence, but it was not possible to stop.

Index: Where were you when you found out? How did this affect you and your family?

Garip: I was detained on 15 January 2016 at the university in Van. I had to spend one night and one day in a jail cell of the special anti-terror unit of the police. I realised that I was a hostage from the beginning. I was threatened and humiliated during my interrogation. My family (who live mostly in Norway and Austria) was extremely concerned for my life. They still recall the events of the 1990s in Turkey, when many people were jailed/tortured or murdered, including the well-known cases of Hrant Dink and Tahir Elci, as well as many other intellectuals. The signatories have also been publicly exposed in the press and social media by government supporters and nationalists, leading to fears of reprisals from a mafia boss who declared that they will “spill the blood” of the signatories.

Index: What was the most difficult part?

Garip: I was removed from my academic position at Yuzuncu Yil (One Hundredth Year) University in Van in February 2016 because I had signed the petition by Academics for Peace, calling on the Turkish government to pursue a peaceful approach in its conflict with the Kurds, and in order to further punish me, the government forbade me to leave the country. I experienced a kind of structural violence, to live in Turkey without a job, health insurance, or a home. I shared a flat with friends for a while. I was trying to survive under very difficult conditions. I also experienced psychological violence. For example, all my phone calls were tapped and I was under regular surveillance. These had a very deep psychological effect on me. I didn’t want to meet with friends because I was constantly afraid of being attacked, imprisoned, killed, or tortured.

Under such circumstances is almost impossible to teach or produce any kind of academic work, write articles, do research, and so on.

It was painful to observe a country sink into political disaster again. Escalation of tensions, political collapse, and the war go back to the 90s, with civil war, political murders, missing people, bombing attacks on peaceful gatherings and meetings. It is also difficult to accept that at the moment approximately 70,000 students are in prison. One of my best students (who is only 22 years old) has been sentenced to 10 years in prison.

Index: Did you have to conceal your Kurdish heritage when studying or teaching?

Garip: No, I have never concealed my heritage. On the contrary, I disclosed my Kurdish heritage from the first day of teaching at the university in Van. Every day I talked to my students first in Kurdish and then continued in Turkish or sometimes in English. I arranged a Kurdish language course for sociology students as well. Kurds in Turkey have been assimilated for many years, a humiliating experience. Most Kurdish students have been psychologically damaged/traumatised by the violence perpetrated by the Turkish government. It was important to me to give my students a feeling of self-worth. This enabled me to establish a foundation of trust with my students, something not many other academics did.

Index: Why do you think academics are being brought to trial? What is the government’s goal?

Garip: It should be mentioned that Turkey has never, since its inception in 1921 until today, been a truly democratic country. Neither academic freedom nor freedom of speech has ever truly existed. The Turkish government has always thought of academics as well-paid public servants, a position which enjoys great privilege. Most Turkish academics have generally been loyal to the state and supported the official ideology. The petition for peace represented the first time that academics showed disloyalty to the state ideology, especially with regard to the Kurdish issue. For an authoritarian regime, such criticism was simply not acceptable. In this way, the government will punish academics. Turkey now appears to be inclined to go from an authoritarian regime to a totalitarian one. All undemocratic regimes try to maintain total control over society (the consolidation of institutional powers such as the NS regime). The masses must be repressed, and the media and intellectuals must be silenced and browbeaten. This is the goal of the government, which is why academics have been brought to trial. The academics have been punished in a number of different yet effective ways: dismissal, foreign travel bans, disciplinary processes.

Index: What has been the biggest change for academics in the country since the attempted coup?

Garip: The universities, schools, media, judiciary, and also parliament are now under the total control of the government. In particular, schools, the media, and universities have been shaped by a new ideology, which is both religious and nationalist. Many academics have been dismissed; more than 150,000 people in the public sector have lost their jobs. In the wake of the civilian putsch, 40,000 teachers, 8,247 academics, and 4,000 prosecutors and judges have been dismissed.

At universities, cultural events and demonstrations are forbidden. Students are not allowed to choose topics for their master or doctoral studies. At the moment four academics are in prison and another 15 academics and I have been sentenced to one year and three months in prison. Academics in Turkey are trying to survive; many of them live in very poor conditions. They have come up with new ideas such as establishing houses of culture or academies on the street. It is important to mention that academics and intellectuals all over the world, including Judith Butler, Etienne Balibar, and many other prominent academics have supported academics in Turkey. The quality of education is declining rapidly because many well-educated professors and instructors are leaving Turkey.

Index: Was there backlash from other academics when the petition came out?

Garip: Yes, at first. After the petition for peace came out, a petition titled “We support our government against terrorism” was signed by 5,000 academics. Some colleagues at the university definitely distanced themselves from me. The reason for this was partly ideological and partly out of fear. However, some academics supported me, as did most of my students.

Index: Do you feel the current climate will ever improve within the country?

Garip: I don’t like to be completely pessimistic but it is very difficult to expect much change within a short period. Possibly the situation may improve over the long term. At the moment we are confronted with a regime change and a government acting in desperation. Turkish society is extremely polarised and the political climate embittered. Structures within the government have been almost completely stripped down. It will be not easy to shift society from an authoritarian structure to a democratic one. We cannot forget that half of Turkey wants a secular and democratic government.

Index: You are now based in Germany – how does it feel to teach again?

Garip: It is wonderful. Here I enjoy a climate of freedom with my students. As I stated above, I have academic freedom and freedom of speech here which I wish my Turkish friends also had. While I was in Van, Turkey I invited many professors from London, Canada, and Germany to give lectures to my students via Skype. I wish to thank them for their excellent contributions. If I have the opportunity I would like to teach my students in Van from Germany via Skype as well.

Index: How has your work changed since leaving Turkey?

Garip: To be honest it was not easy to settle down. I had to start from the bottom again. But thanks to the social government and constitutional democracy in Germany, I was fortunate to receive help from many of my friends. I received a scholarship first for three months from the University of Essen-Duisburg and now have a fellowship from the University of Cologne. I am currently working on a research project. I have finished a new article and can publish it without fear. In short, I enjoy academic freedom and freedom of speech again. I wish all my friends in Turkey could enjoy such freedoms as well.

Index: Do you think you will ever return to Turkey?

Garip: Yes, of course I will. Travelling is an essential human right. I will visit my friends there or attend conferences and work on research projects.

Turkish petition for peace puts academic freedom on trial

[vc_row][vc_column][vc_column_text]For Turkish academics, signing a dissenting petition can mean expulsion from their job, the country or even jail time. In Noémi Lévy-Aksu’s case, signing the Academics for Peace petition, “We will not be a party to this crime!” meant losing her teaching position at Boğaziçi University.

In March 2017, Lévy-Aksu had flown from London to Turkey to take an exam to become an associate professor. After the exam, she flew back to London to continue her fellowship at the British Academy with an affiliation with Birkbeck College. However, two days later she received an email saying she had been dismissed from her teaching position at Boğaziçi. Following the news of her work and residence permit cancellation, she was notified that she had passed her associate professor exam. In April, she became a Turkish citizen after applying for citizenship in January 2016.

The confusing whirlwind of events left Lévy-Aksu jobless with Turkish citizenship and associate professor credentials. Her story is far from unique as President Recep Tayyip Erdoğan has increased his government’s squeeze on dissenting voices —  whether journalistic, legal or academic.

While best known for the January 2016  “We will not be a party to this crime!” petition, Academics for Peace advocates for peace between Kurds and Turks and condemns government violations of its own and international laws. The organisation, which formed in 2012, is an amalgamation of academics from over 50 universities.

With over 2,000 signatures, the petition hurtled Turkish academics into the dissenting spotlight, prompting Erdoğan to arrest and dismiss academics through emergency decrees. The purges only escalated after the unsuccessful coup in July 2016. Since last November, many signatories have been held on criminal charges and accused of terror propaganda. Ostensible “terrorists” in Turkey, professors and other intellectuals like Lévy-Aksu have been persecuted, which has led to job loss, passport revocation and prison.

In Lévy-Aksu’s case, she has been one of the luckier academics. With her dual French and Turkish citizenship, Lévy-Aksu is able to easily enter and leave the country where she attends hearings of her fellow colleagues and offers her continued solidarity. She is currently finishing up her fellowship in London and recently began studying law at BPP University Law School.

Lévy-Aksu spoke with Sarah Wu of Index on Censorship about the current situation for Turkish academics. Below is an edited version of their conversation:

Index: What role did your participation in Academics for Peace play in your dismissal?

Lévy-Aksu: That was that exact reason why I was fired. It was openly stated. I had been involved in Academics for Peace while I was in Turkey, and when I came to London, I became involved in its UK branch. The Council of Higher Education gave no reason when they revoked my work permit at my university, which was the same case for another foreign academic in the sociology department. When I decided to sue the Council of Higher Education, my lawyer first asked what the reason for dismissal was, and they then said the petition was the main reason. This is the core issue in the ongoing administrative lawsuit I opened against the Higher Education Council and Boğaziçi.

Index: Were your reasons for signing the petition personal or professional?

Lévy-Aksu: I think it was a reaction motivated by anger and the need to say something against what was going on, not only as an academic but as a citizen. Although I was not a Turkish citizen at the time, as a human being I have this duty to speak up and not to stay silent. It was a way to morally and politically react to what was going on and doing it collectively made sense at the time.

Since the beginning of the Turkish Republic, the Kurdish region and Kurdish populations have been consistently targeted by state oppression. Seeing this happening again and again, [signing this petition] was just a way to say, ‘Not again’. The petition was a way, especially for Turkish academics not in the Kurdish region, to say that they were concerned, aware of what was going on, and eager to voice their disagreement.

Index: Do you have any anxiety while traveling to and from Turkey?

Lévy-Aksu: Being a foreigner at the time worked in my favor. My main concern, besides being dismissed, was being expelled from the country, which is quite common for foreign troublemakers. So I applied and surprisingly got the citizenship after being dismissed from the university. It’s funny because I lost my job and then became Turkish. I am therefore lucky enough to travel and I go to Turkey as often as I can as it is still the place I feel I belong to.

Every time I go to Turkey, I hear a lot of criticisms in private by people who are not just political, but by people who want this oppression to stop. Even if they are not leftist or Kurdish, more or less everyone has been affected by the purges or repression. But it’s different when it comes to public discontent. People are now arrested for a tweet or a social media post. A line can send you to prison. So you have to be really brave. The space for opposition has dramatically shrunk.

I still think it’s remarkable that people are still ready to protest despite risking arrest, and if you think about western societies, I’m not sure there would be more resistance in the same context. Who is ready to sacrifice his career, to lose his job, but also his liberty? I think this is a problem that not only concerns Turkey. You need to be really brave to continue speaking up.

There are so many examples of academics and non academics who are, despite all risks, resisting in Turkey. Showing solidarity is the least we can do.

Index: How did the rest of your colleagues fare?

Lévy-Aksu: It depends. My university has been spared of the purges besides me and my other colleague, Prof. Abbas Vali. But in comparison to other universities, I have been much luckier than many others. A great number of friends are stuck in Turkey because their passports have been revoked and are having difficulties finding a job outside of academia. Colleagues in London and other parts of Europe are also in difficult situations. For them, sometimes their passports are revoked after they come here, so now they are stuck and visa renewals are difficult. If they go back, they know they won’t be able to leave Turkey again. It’s a very complex situation, not to mention the financial and job search difficulties. In addition, several signatories of the petition have already been sentenced to 15 months imprisonment (with possibility of a suspensive appeal) for terror propaganda and hundreds of other cases are going on.

Index: Erdoğan was arrested for reading a poem and now he’s doing the same thing with academics. Do you think he is thin-skinned and fearful for his reputation, or is there a deeper meaning behind the academic purges?

Lévy-Aksu: He is relying on the lack of sound democratic tradition, which is what all the previous leaders of the Turkey have done in the past. But of course, the level of control on the institution he has is probably unparalleled in Turkish history.

He has established a system that attempts to control all of society, which attempts to reduce all opposition. It is done now complicitly by many decision makers. These people in institutions are, either by ideological conviction or by fear, doing what is expected of them so that the power can maintain itself. The system, which is bigger than Erdoğan himself, is frightening. It extends to the justice institution, the education system and police. Even more worrying are the mechanisms of denunciation, the use of society and encouragement to denounce your neighbors, your colleagues.

We see it in the universities. Colleagues are denounced by students. Students are denounced by students. You have all these mechanisms that contribute to the polarisation of society and increase fear and potential violence. On both sides, you feel this palpable tension. Even if Erdoğan left, it would not be easy to solve.

Index: Where do you think Erdoğan is taking the university system?

Lévy-Aksu: There’s a push to make religious values the core of education, and it’s something we’ve already felt even before the coup. This increasingly conservative, religious and nationalistic discourse means certain topics can’t be discussed, which means academics can be denounced for expressing critical opinions.

This is the case at my former university. There have been many arrests of students and police are on campus. There was an incident between pro-government and leftist students after the Afrin operation and Erdoğan called for the arrest of those students and a ‘cleaning of the university,’ calling them terrorists, communists and treacherous students and saying they should not be given the right to education. Police are on campus, they are arresting students from the dormitories, and they check IDs in the library – this is what’s happening.

They’re establishing fear not only for politically engaged students but all the academic community, who expect university to be a place of knowledge, not a place of control and repression. Unfortunately, every kind of institution and place of social life is transforming into a place of surveillance and control, and this is the case for universities all over Turkey. Most of them have been extensively purged and most are controlled by the police and administration and by the collaboration of state representatives.

I think it’s a very dark picture. It’s getting darker and darker especially with the beginning of the Turkish military operation in Syria, which again gave a new reason for emphasising nationalist, religious values and arresting people who protested against this military intervention.

Index: Do you think the best form of support for the academics in Turkey is to show solidarity, is it enough?

Lévy-Aksu: This is an ongoing debate among the academics who are still in Turkey and those who are abroad. Of course solidarity is important. It can be financial solidarity with the academics dismissed, it can be helping an academic pursue their research and networking, or giving them access to online classes if they cannot move. Academics for Peace networks in Europe and the US are lobbying to encourage organisations such as Scholars at Risk or CARA, state or regional institutions and foundations to create positions for dismissed academics. In the UK, we have just established the Centre for Democracy and Peace Research to develop projects and partnership to support dismissed academics and, beyond this, critical research and production of knowledge.  

Another possible form is one that started last year by the Academics for Peace. The call to freeze all cooperation with complicit universities. It’s a call that has been made by the Academics for Peace networks in the UK, France, Germany and the US. It established a list of complicit universities and calls for academics not to cooperate formally with them. It means not participating in conferences organised by complicit universities and not inviting directors of the universities. As an institutional boycott, it targets the institutions that are persecuting the ideas and opinions of academics.

Until now, it’s had some limited impact. One of the reasons is that it’s not easy for academics to understand the situation in Turkey. Colleagues in Turkey too are divided on this. For some, they think it’s important to keep strong relations with foreign institutions, including bringing colleagues to the university even if it witnessed some arbitrary dismissal. For the ones that have been dismissed, they are expecting this kind of reaction.

I understand there can be reluctance against boycotting, but I think the bare minimum is for people who go to Turkey is to be aware of what is going on. Foreign academics should be able to raise criticisms or questions if they choose to visit these institutions. Otherwise, you become complicit in a way through your silence and not seeing what’s going on. Academics who visit these complicit universities are strongly resented by colleagues who are in Turkey and feel invisible and unable to travel. I think awareness of what’s going on in different countries and global solidarity is important.

I understand that colleagues who have worked with Turkish colleagues for a long time enjoy going to Turkey because it relates to their fieldwork and they have developed fruitful academic collaborations there. Yet knowing these institutions that have persecuted other academics for their opinions should raise moral questions before you visit. War abroad, repression at home: Turkey’s academics and students caught up in new wave of arrests

[vc_row][vc_column][vc_single_image image=”99469″ img_size=”full” add_caption=”yes” alignment=”center”][vc_column_text]Since Turkey launched a military operation in Afrin, northern Syria, in January, state repression against critical voices has escalated once more. Hundreds of Turkish citizens who expressed their opposition to war, massacres and the displacement of Kurdish civilians have been arrested.

As with two years ago, when a petition by academics against the ongoing war in the Kurdish region was released, demanding peace has been deemed as supporting terror by the government and the pro-governmental media.

On 26 February 2018 a statement from the Ministry of Interior confirmed that 845 people were detained for criticising Turkey’s Afrin operation — code-named Operation Olive Branch — on social media and taking part in protests. Each week now brings new arrests on similar grounds, with students and academics caught up in the wave of repression.

In early February two academics, Onur Hamzaoğlu and Serdar Başçetin, were arrested. Hamzaoğlu is a doctor well known for his research into the correlation between industrial pollution and cancer in Kocaeli Province. He was dismissed from Kocaeli University, along with other signatories of the petition, by an emergency-decree after the attempted coup in July 2016. Hamzaoğlu is a co-founder of the Kocaeli Solidarity Academy and a co-spokesperson of the People’s Democratic Congress (HDK), a union left-wing parties and civil society organisations, formed in 2011 with the aim of recreating politics and promoting a democratic society against social, ethnic, religious and gender discrimination. He was arrested on 9 February before the HDP Congress and is still detained, together with dozens of party members.

Serdar Başçetin was a research assistant who was fired from Erzincan University by emergency decree. He was arrested in Antalya on 13 February for his support to Nuriye Gülmen and Semih Özakça during their hunger strikes and his posts on Afrin on social media. On 29 March he was acquitted of all charges at the first hearing.

Students at Boğaziçi University, one of the leading higher education institutions in the country, known for its autonomy and liberal traditions, have also come under attack. The so-called “Afrin delight” incident started on 19 March when pro-governmental students opened a stand on campus to distribute Turkish delights in honour of the Afrin expedition and the Turkish soldiers who lost their lives there. Tension raised when students carrying a banner reading “No delight for occupation and massacre” protested against the stand and both groups started to fight. What could have remained an incident indicative of the political tensions that exist between students turned into a pretext for a wide police operation on campus. Arrests began on 22 March when five students were rounded-up in the early morning in the dormitories and homes. A press statement organised on the North Campus condemning these arrests gave way to a violent police intervention and further arrests.

In the days that followed president Erdogan himself condemned the “no delight” students, calling them terrorists and adding that these “communists” and “traitors” would not be given right to education. Academics were warned by the president that there would be consequences if they co-operated with these students.

Some students reported being kept for long hours in a police van, severely beaten, insulted and, for some of them, sexually assaulted before being released. Since then, police have been patrolling the campus, leading to fresh arrests. Some of those arrested weren’t even involved in the initial incident. On 3 April, when 15 Boğaziçi students were brought before Çağlayan courthouse, ten were sentenced to pre-trial detention. For their anti-war slogans, they were accused of spreading terrorist propaganda. They remain in prison.

This repression came as no surprise. On 7 January, while speaking at the university on the invitation of a conservative alumni association, Erdogan had criticised the university in the presence of the rector for not being “local and national” enough. Yet Boğaziçi’s loss of autonomy had actually started much earlier. In November 2016, showing no consideration for the summer elections that had seen the previous rector re-elected with more than 80% of votes, Erdogan appointed professor Mehmed Özkan, a Boğaziçi academic who hadn’t even been a candidate in the election. Despite protests by a small group of academics and students, Özkan’s election was greeted with relief by the majority of academics, trusting his promise to protect the liberal tradition of the university and its academic staff. Academic freedom and freedom of expression have come under joint attack from the government and the university administration.

In March 2017 I was dismissed from Boğaziçi, along with professor Abbas Vali, for signing the petition for peace. The Higher Education Council revoked our work permit and the university cancelled our contracts. We were singled out as the two foreign signatories of the petition. Before us, Murat Sevinç, an academic dismissed by emergency-decree from Ankara University, had already been compelled to stop his part-time teaching at Boğaziçi. The rector’s justification for our dismissal was the duty to obey orders – the universal excuse of civil servants trying to escape their responsibilities – and the need to protect the institution against further attacks. Fortunately, this view was challenged by some supportive colleagues and an extraordinary mobilisation of students from the history department who set up a tent throughout the Spring term on the North Campus, where they attempted to raise awareness of our dismissal by inviting academics to participate in outdoor lectures and workshops.

Yet it was already clear by then that the attacks against critical academics across the country and the appointment of a pro-governmental rector had dramatically shrunk the space for critique and opposition on campus. As with elsewhere in Turkey, fear of repression and a disillusionment with the possibility for change grew, and with it, self-censorship spread among academics and students.

Since then, things have only worsened for critical academics and students across the country. In October 2017 the Ministry of Justice made public that more than 36,000 students were detained in Turkey, raising to nearly 70,000 when open university students are included. While the number of students currently detained is likely to be even higher, these figures reflect the heavy price paid by critical students, deprived of their liberty and their right to education for expressing their opposition to state policy. Meanwhile, the trial against the Academics for Peace is ongoing in Istanbul and several academics have already been sentenced to a 15-months suspended prison sentence for spreading terrorist propaganda because they signed the 2016 petition. On 4 April, professır Füsun Üstel, from Galatasaray University,  another academic was given a 15-month prison sentence, with the right to appeal the decision.

Aside from the purges, the state authorities encourage a culture of denunciation through dedicated online platforms, where complaints can lead to a police or administrative investigation. The Education Council relentlessly fights against the remaining spaces of academic freedom, relying on the active complicity of most universities’ administrative boards. Both academics’ right to critique and students’ right to education are under threat. After the Boğaziçi incident, the Higher Education Council announced that they considered adopting new disciplinary procedures against students. The same day, in a statement published on Boğaziçi University website, the rectorate denounced terror, welcomed police intervention on campus and announced disciplinary procedure for students who protested against the Afrin expedition, cynically referring to the university’s commitment to “freedom of expression” of the other camp.
