Eminent sociologist Nandini Sundar, who won the prestigious Infosys Prize for social science in 2010, stands accused of murder in the death of a villager in a region she has studied intensely since 1990.
Two Indian social scientists are among 10 people charged with murder in Chhattisgarh, an Indian state wracked by an ongoing insurgency by Maoist rebels that the academics were actively studying.
Neither Nandini Sundar, an eminent sociologist at Delhi University, nor Archana Presad, a labour historian at Jawaharlal Nehru University, are specifically charged with wielding the weapons that killed villager Shamnath Baghel on 4 November. Instead, the charges filed after a complaint by the wife of the victim suggest that they were complicit in the attack. Sundar has called the complaint, known as first information report, or FIR, “patently absurd”.
“This is a vendetta against all researchers, journalists, lawyers and activists who are willing to expose complete lawlessness of police,” she said, adding that she condemns the killing of the villager.
A large number of Indian and global sociologists have condemned the arrest specifically and the stifling of freedoms of expression and academic inquiry more broadly in India. More than 180 Indian sociologists and more than 30 from outside India signed a statement critical of the arrest. “As sociologists we are forced to condemn the growing nation-wide trend towards the stifling of all voices of dissent from academia, the media and cultural and literary practitioners. Disabling independent research and silencing contrary views undermines the collective ability to build a better future.”
Their statement cited other recent instances: “We note with concern the increasing incidents of attempts to intimidate or falsely accuse members of our profession, be it Prof. Vivek Kumar in Gwalior, Prof. Rajesh Mishra in Lucknow or Prof. M.N. Panini in Jharkhand.”
Baghel was killed, allegedly by Maoist rebels (known as Naxalites), after protesting insurgent activities in the Sukma district of south Chhattisgarh. Baghel and others had started their movement in April, and in May had filed his own complaint against Sundar, Prasad, Vineet Tiwari from the NGO Joshi Adhikar Sansthan, the Communist party’s local state secretary Sanjay Parate and several reputed Maoists for the group’s alleged encouragement of Maoist activities. “According to villagers,” Inspector General of Police SRP Kalluri told the Indian wire service PTI, “Sundar and others went in the village to allegedly threaten them not to oppose the Maoists”. The specific charges are for conspiracy, murder and rioting.
Hostility between academics and the authorities is nothing new.
Sundar’s wide-ranging scholarship has included detailed studies of Chhattisgarh, most recently in a book, The Burning Forest: India’s War in Bastar, released in September. As eSocialSciences described it, “The book is a product of painstaking research and is a vivid account of the human rights abuses by the Maoists and the government and the absence of justice” drawn from Sundar’s 25 years studying the area.
In 2011 Sundar successfully petitioned India’s Supreme Court to disband a state-backed militia known as Salwa Judum that was battling the Maoists. Kalluri was active in directing those “special police officers” and Sundar believes the criminal charges come as “a direct fall-out” from accusing Kalluri for being responsible for violence committed during that period.
“How can we be charged with murder and rioting when we are not even there?” Sundar said in a statement. “This is clearly part of IG Kalluri’s attempt to intimidate and harass journalists, lawyers, researchers, political leaders and human rights activists who have exposed the reign of fake encounters, gang rapes etc. that are going on in Bastar.”
Kalluri, for his part, has linked Sundar directly with the Maoists, saying she was part of a delegation of Maoists that “roamed freely” throughout Bastar in May and threatened villagers trying to defend themselves. “We don’t mind anyone supporting some ideology, but they should not incite innocent tribals to rebel against the state,” Kalluiri said, referring to the indigenous Bastari. “There is sufficient background, there is a prelude, correspondence and evidence.” The complaint, according to an article in The Hindu, includes claims that “Maoists kept telling Baghel that he was being punished because he did not listen to Ms. Sundar and others, and continued opposing them”.
Sundar said the May trip was a fact-finding expedition looking at brutality from all sides. She issued a press release detailing the delegation’s findings, which seems at odds with Kalluri’s claims that Sundar was using a false name.
The authorities were monitoring Bastar had Sundar before this killing. Last month, the police and security forces in Chhattisgarh burnt effigies of Sundar alongside those of activists, writers and a journalist. After Sundar’s arrest, Kullari told NDTV that “activists are enemies because they incite the people of India”.
Historian Ramchandra Guha tweeted: “This vicious and vindictive FIR proves beyond doubt that Chhattisgarh is a police state.”

One of South Asia’s most influential news magazines, Himal Southasian, is to close next month after 29 years of publishing as part of a clampdown on freedom of expression across the region. The magazine has a specific goal: to unify the divided countries in South Asia by informing and educating readers on issues that stretch throughout the region, not just one community.
Index got a chance to speak with Himal Southasian’s editor, Aunohita Mojumdar, on the vital role of independent media in South Asia, the Nepali government’s complicated way of silencing activists and what the future holds for journalism in the region.
“The means used to silence us are not straightforward but nor are they unique,” Mojumdar said. “Throughout the region one sees increasing use of regulatory means to clamp down on freedom of expression, whether it relates to civil society activists, media houses, journalists or human rights campaigners.”
Himal Southasian, which claims to be the only analytical and regional news magazine for South Asia, faced months of bureaucratic roadblocks before the funding for the magazine’s publisher, the Southasia Trust, was cut off due to non-cooperation by regulatory state agencies in Nepal, said the editor. This is a common tactic among the neighbouring countries as governments are wary of using “direct attacks or outright censorship” for fear of public backlash.
But for Nepal it wasn’t always this way. “Nepal earlier stood as the country where independent media and civil society not accepted by their own countries could function fearlessly,” Mojumdar said.
In a statement announcing its suspension of publication as of November 2016, Himal Southasian explained that without warning, grants were cut off, work permits for editorial staff became difficult to obtain and it started to experience “unreasonable delays” when processing payments for international contributors. “We persevered through the repercussions of the political attack on Himal in Parliament in April 2014, as well as the escalating targeting of Kanak Mani Dixit, Himal’s founding editor and Trust chairman over the past year,” it added.
Index on Censorship: Why is an independent media outlet like Himal Southasian essential in South Asia?
Aunohita Mojumdar: While the region has robust media, much of it is confined in its coverage to the boundaries of the nation-states or takes a nationalistic approach while reporting on cross-border issues. Himal’s coverage is based on the understanding that the enmeshed lives of almost a quarter of the world’s population makes it imperative to deal with both challenges and opportunities in a collaborative manner.
The drum-beating jingoism currently on exhibit in the mainstream media of India and Pakistan underline how urgent it is for a different form of journalism that is fact-based and underpinned by rigorous research. Himal’s reportage and analysis generate awareness about issues and areas that are underreported. It’s long-form narrative journalism also attempts to ensure that the power of good writing generates interest in these issues. Based on a recognition of the need for social justice for the people rather than temporary pyrrhic victories for the political leaderships, Himal Southasian brings journalism back to its creed of being a public service good.
Index: Did the arrest of Kanak Mani Dixit, the founding editor for Himal Southasian, contribute to the suspension of Himal Southasian or the treatment the magazine received from regulatory agencies?
Mojumdar: In the case of Himal or its publisher the non-profit Southasia Trust, neither entity is even under investigation. We can only surmise that the tenuous link is that the chairman of the trust, Kanak Mani Dixit, is under investigation since we have received no formal information. Informally we have indeed been told that there is political pressure related to the “investigation” which prevents the regulatory bodies from providing their approval.
The lengthy process of this denial – we had applied in January 2016 for the permission to use a secured grant and in December 2015 for the work permit, effectively diminished our ability to function as an organisation until the point of paralysis. While the case against Dixit is itself contentious and currently sub judice, Himal has not been intimated by any authority that it is under any kind of scrutiny. On the contrary, regulatory officials inform us informally that we have fulfilled every requirement of law and procedure, but cite political pressure for their inability to process our requests. Our finances are audited independently and the audit report, financial statements, bank statements and financial reporting are submitted to the Nepal government’s regulatory bodies as well as to the donors.
Index: Why is Nepal utilising bureaucracy to indirectly shut down independent media? Why are they choosing indirect methods rather than direct censorship?
Mojumdar: The means used to silence us are not straightforward but nor are they unique. Direct attacks or outright censorship are becoming rarer as governments have begun to fear the backlash of public protests.
Index: With the use of bureaucratic force to shut down civil society activists and media growing in Nepal, how does the future look for independent media in South Asia?
Mojumdar: This is actually a regional trend. However, while Nepal earlier stood as the country where independent media and civil society not accepted by their own countries could function fearlessly, the closing down of this space in Nepal is a great loss. As a journalist I myself was supported by the existence of the Himal Southasian platform. When the media of my home country, India, were not interested in publishing independent reporting from Afghanistan, Himal reached out to me and published my article for the eight years that I was based in Kabul as a freelancer. We are constantly approached by journalists wishing to write the articles that they cannot publish in their own national media.
The fact that regulatory means to silence media and civil society is meeting with such success here and that an independent platform is getting scarce support within Nepal’s civil society will also be a signal for others in power wishing to use the same means against voices of dissent.
It is a struggle for the media to be independent and survive. In an era where corporate interests increasingly drive the media’s agenda, it is important for all of us to reflect on what we can all do to ensure the survival of small independent organisations, many of which, like us, face severe challenges.

Anonymity is out of fashion. There are plenty of critics who want it banned on social media. It’s part of a harmful armoury of abuse, they argue.
Certainly, social media use seems to be doing its best to feed this argument. There are those anonymous trolls who sent vile verbal attacks to writers such as US author Lindy West. She was confronted by someone who actually set up a fake Twitter account under the name of her dead father.
Anonymity has been used in other ways by the unscrupulous. Earlier this year, a free messaging app called Kik was the method two young men used to get in touch with a 13-year-old girl, with whom they made friends online and then invited her to meet. They were later charged with her murder. Participants who use Kik to chat do not have to register their real names or phone numbers, according to a report on the court case in the New York Times, which cited other current cases linked to Kik activity including using it to send child pornography.
So why do we need anonymity? Why does it matter? Why don’t we just ban it or make it illegal if it can be used for all these harmful purposes? Anonymity is an integral part of our freedom of expression. For many people it is a valuable way of allowing them to speak. It protects from danger, and it allows those who wouldn’t be able to speak or write to get the words out.
“If anonymity wasn’t allowed any more, then I wouldn’t use social media,” a 14-year-old told me over the kitchen table a few weeks ago. He uses forums on the website Reddit to have debates about politics and religion, where he wants to express his view “without people underestimating my age”.
Anonymity to this teenager is something that works for him; lets him operate in discussions where he wants to try out his arguments and gain experience in debates. Anonymity means no one judges who he is or his right to join in.
For others, using a fake or pen name adds a different layer of security. Writers for this magazine worry about their personal safety and sometimes ask for their names not to be carried on articles they write. In the current issue, an activist who works helping people find ways around China’s great internet wall is one of our authors who can’t divulge his name because of the work he does.
Throughout history journalists have worked with sources who want to see important information exposed, but do not want their own identity to be made public. Look at the Watergate exposé or the Boston Globe investigation into child sex abuse by priests. Anonymous sources can provide essential evidence that helps keep an investigation on track.
That right, to keep sources private, has been the source of court actions against journalists through the years. And those who choose to work with journalists, often rely on that long held practice.
Pen names, pseudonyms, fake identities have all have been used for admirable and understandable purposes over the centuries: to protect someone’s life; to blow a whistle on a crime; for a woman to get published at a period when only men did so, and on and on. Those who fought for democracy, the right to protest and other rights, often had operate under the wire, out of the searching eyes of those who sought to stop them. Thomas Paine, who wrote the famous pamphlet Common Sense “Addressed to Inhabitants of America”, advocating the independence of the 13 states from Britain, first published his words in 1776 anonymously.
From the early days of Index on Censorship, when writing was being smuggled across borders and out of authoritarian countries, the need for anonymity was paramount.
Over the years it has been argued that anonymity is a vital component in the machinery of freedom of expression. In the USA, the American Civil Liberties Union argues that anonymity is a First Amendment right, given in the Constitution. As far back as 1996, a legal case was taken in Georgia, USA, to restrict users from using pseudonyms on the internet.
Today, in India, the world’s largest democracy, there are discussions about making anonymity unlawful. Our article by lawyer and writer Suhrith Parthasarathy considers why if minister Maneka Gandhi does go ahead with plans to remove anonymity on Twitter it could have ramifications for other forms of writing. As Anja Kovacs of the Internet Democracy Project told Index, “democracy virtually demands anonymity. It’s crucial for both the protection of privacy rights and the right to freedom of expression”.
We must make sure that new systems aimed at tackling crime do not relinquish our right to anonymity. Anonymity matters, let’s remember it has a role to play.
