International signatories from the worlds of technology, journalism, publishing, theatre, film and business, including jewellers Tiffany & Co, called on Angolan president José Eduardo dos Santos on Tuesday to drop the prosecution of award-winning investigative journalist Rafael Marques de Morais.

Marques was last week given a six-month suspended sentence following a trial in which he faced criminal defamation charges over his 2011 book on blood diamonds, which was published for the first time in English on Tuesday.

“Rafael’s trial was a sham. He was told charges would be dropped, only for him to be hit with new charges out of the blue, and he was not allowed to present his evidence or call witnesses,” said Jodie Ginsberg, CEO of freedom of expression group Index on Censorship, which organised the letter.

“Rafael is a courageous journalist, working with little support to expose corruption in Angola. This absurd trial and verdict is meant to stop him from speaking out. We want to make sure that does not happen.”

Marques was awarded an Index on Censorship Freedom of Expression award in March for his work. Signatories to the letter include jewellers Tiffany & Co.; tech entrepreneurs Martha Lane Fox, one of the judges of the awards, and Wikipedia founder Jimmy Wales; authors Philip Pullman, Neil Gaiman and Elif Shafak; actors Janet Suzman, Juliet Stevenson, and Simon Callow; playwrights Howard Brenton and Timberlake Wertenbaker; as well as Steve McQueen, director of Oscar-winning film 12 Years a Slave. Other signatories included journalists Sir Harold Evans and Christina Lamb; and artists and writers with direct experience of censorship, such as Syrian political cartoonist Ali Ferzat and Azerbaijani journalist Idrak Abbasov.

The letter will be delivered by Index on Censorship to the Embassy of Angola in London on Tuesday, June 2.

We, the undersigned, call on Angolan President José Eduardo dos Santos to drop the prosecution of journalist Rafael Marques de Morais.

Marques’ vital investigations into human rights abuses should not be impeded by the threat of jail, which is set to loom over him for two years under the court’s terms.

His conviction and six-month suspended sentence are a clear violation of the rights to free expression, to a free press and to a fair trial.

Marques’ reporting is fundamental not only to Angola, but to the world at large.

We call on you to ensure standards of international law are applied during the appeal process.

The brutal attack against Charlie Hebdo has seen European leaders rally round the fundamental value of freedom of expression.

French President Francois Hollande led the way by stating: “Today it is the Republic as a whole that has been attacked. The Republic equals freedom of expression.” Prime Minister David Cameron vowed that Britain will “never give up” the values of freedom of speech, and German Chancellor Angela Merkel called the events in Paris “an attack on freedom of expression and the press — a key component of our free democratic culture.” European Union President Donald Tusk stressed that “the European Union stands side by side with France after this terrible act. It is a brutal attack against our fundamental values, against freedom of expression which is a pillar of our democracy.”

This unified commitment to freedom of expression is both admirable and crucial in the aftermath of the killing of cartoonists armed with nothing more than ink, humour and courage. It is also true that freedom of expression is a fundamental European value and that (Western) Europe allows for a much freer debate than most other places in the world. However, European governments and institutions have long compromised this freedom through statements and laws that narrow the limits on permissible speech. Ironically some of these statements and laws target the very kind of offence that Charlie Hebdo excelled in.

Donald Tusk’s principled defence of freedom of expression stands in stark contrast to a 2012 joint statement issued by then EU High Representative for Foreign Affairs Catherine Ashton, as well as the Organisation of Islamic Cooperation and the Arab League that “condemn[ed] any advocacy of religious hatred … While fully recognising freedom of expression, we believe in the importance of respecting all prophets”. The statement followed the furore over the crude anti-Islamic film “The Innocence of Muslims”, and suggests that mocking prophets is tantamount to religious hatred prohibited under international human rights law and thus exempted from the protection of freedom of expression.

The controversy over The Innocence of Muslims prompted none other than Charlie Hebdo to print its own depictions of Mohammed, including one showing Islam’s prophet naked. That decision drew stern condemnations from the French government. Then Foreign Minister Laurent Fabius remarked that “in the present context, given this absurd video that has been aired, strong emotions have been awakened in many Muslim countries. Is it really sensible or intelligent to pour oil on the fire?”

While Charlie Hebdo has won a number of lawsuits other French figures have been convicted or censored under French law. Last year comedian Dieudonné M’bala M’bala was banned from performing his comedy shows publicly, due to their anti-semitic content. And France is not alone. Swedish shock artist Dan Park was sentenced to six months imprisonment in 2014, over a number of purportedly racist posters deemed “gratuitously offensive” to minority groups by a Swedish court. The owner of the gallery that had displayed the cartoons was also convicted and the posters ordered destroyed.

In 2011, a prominent Austrian Islam-critic was convicted of “denigration of religious beliefs” for stating that the prophet Mohammed “had a thing for little girls”. An elderly Austrian man was found guilty of the same offence for yodelling while his Muslim neighbour was praying. In the United Kingdom, an atheist who left caricatures of the Pope, Mohammed and Jesus in a prayer room in John Lennon Airport was similarly convicted and sentenced to six months imprisonment, though the sentence was suspended. A TV personality’s disparaging social media comments about Scotland and Scots recently prompted Scottish police to tweet that it would “thoroughly investigate any reports of offensive or criminal behaviour online and anyone found to be responsible will be robustly dealt with”.

France and numerous other European countries also have bans against Holocaust denial. In 2010, a Muslim group claiming to expose free speech double standards in the aftermath of the Danish cartoon controversy was convicted after publishing a cartoon suggesting that Jews have made up the Holocaust.

When it comes to countering terrorism, European states increasingly target not only expression that incites terrorism but also expression that may constitute “glorification”. Exactly a week after the attack against Charlie Hebdo, Dieudonné once again ran afoul of the law and was detained over a Facebook post. According to Le Monde at least 50 other cases of terror apology have been opened against people in France since the attack. In Denmark, a number of Islamists have been prosecuted for glorifying terrorism following Facebook postings that seemingly approved of terrorism, including the assault on Charlie Hebdo. Recently British Home Secretary Theresa May unveiled plans that would ban “non-violent extremists” from using television and social media to spread their ideology.

While Europe has a sophisticated and elaborate regional system for the protection of human rights, these institutions have frequently sided with the censors over citizens. In 2008 the EU adopted a framework decision obliging all member states to criminalise certain forms of hate speech. The European Court of Human Rights has found the confiscation of a “blasphemous” film, the conviction of a French cartoonist mocking the victims of 9/11, and the banning of religious fundamentalist group Hizb-ut-Tahrir compatible with freedom of expression. The Council of Europe’s current High Commissioner for Human Rights Nils Muižniekshas called for all 47 member states to enact bans against Holocaust denial and gender based hate speech.

These non-exhaustive examples demonstrate that contemporary Europe’s approach to freedom of expression is far more complicated and far less principled than the statements made by its leading politicians in recent days suggest. It is an approach to freedom of expression based on the premise that social peace in increasingly multicultural societies requires restrictions on freedom of expression in order to avoid offending ethnic and religious groups. Thus in 2004, when Dutch film maker Theo Van Gogh was murdered by an Islamist offended by Van Gogh’s controversial and anti-Islamic film “Submission”, the Dutch minister of justice proposed to revive the country’s blasphemy law which had been disused since 1968.  He argued that “if opinions have a potentially damaging effect on society, the government must act … It is not about religion specifically, but any harmful comments in general.”

Such sentiments might appeal to pragmatists in the wake of the tragedy in France. But there is little reason to think that restricting freedom of expression fosters tolerance and social cohesion across a Europe increasingly divided along ethnic and religious lines, and where anti-semitism and other forms of intolerance is on the rise. In fact such laws seem to fuel the feeling of separateness of modern Europe by legally protecting group identities against offence rather than fostering an identity rooted in common citizenship. While minorities may be offended by disparaging comments, insisting that freedom of expression be limited to protect them from racism and offence, is a very dangerous game at a time where far-right movements with questionable commitment to liberal democracy are on the rise. In this context it should not be forgotten that Dutch politician Geert Wilders once proposed banning the Quran and that the leader of Front National Marine Le Pen wants to ban religious head wear, including the Jewish kippah. The freedoms that (sometimes) allow bigots to bait minorities are also the very freedoms that allow Muslims and Jews to practice their faiths freely. By further eroding these freedoms, no one is more than a political majority away from being the target rather than the beneficiary of laws against hatred and offence. Only by reaffirming a genuine and principled defence of freedom of thought, expression and religion can Europe hope to create a society built on real tolerance and respect for diversity, and where cartoonists neither have to fear gunmen nor jail, but only the moral judgment of their fellow citizens.

If you said “I believe in free expression, but…” at any point in the past week, then this is for you. If you declared yourself to be “Charlie”, but have ever called for an offensive image to be removed from public viewing, then this is for you. If you “liked” a post this week affirming the importance of free speech, but have ever signed a petition calling for a speaker to be banned, then this is for you.

Because the rush to affirm our belief in free expression in the wake of Charlie Hebdo attacks ignores a simple truth: that free speech is being eroded on all sides, and all sides are responsible. And it needs to stop.

Genuine free expression means being able to articulate thoughts, feelings and ideas without fear of harm. It is vital because without it individuals would be subject to the whim of whichever authority dictated what ideas and opinions – as opposed to actions – are acceptable. And that is always subjective. You need only look at the world leaders at Sunday’s Paris solidarity march to understand that. Attendees included Ali Bongo, President of Gabon, where the government restricts any journalism critical of the authorities; Turkish Prime Minister Ahmet Davutoglu, whose country imprisons more journalists in the world than any other; and the UK’s David Cameron, who declared his support for free expression and the right to offend, while his government considers laws that could drive debate about extremism underground.

It is precisely the freedom for others to say what you may find offensive that protects your own right to express your views: to declare, say, your belief in a God whom others deny exists; or to support a political system that others dismiss. It is what enables scientific and academic thought to progess. As soon as we put qualifications around “acceptable” free expression, we erode its value. Yet that is precisely what happened time and again in response to the Charlie Hebdo attacks, with individuals simultaneously declaring their support for free expression while seeming to suggest that the cartoonists and anyone else who deliberately courts offence should choose other ways to express themselves – suggesting that the responsibility for “better” speech always lies with the person deemed to be causing offence rather than the offended.

Index believes that the best way to tackle speech with which you disagree, including the offensive, and the hateful, is through more speech, not less. It is not through laws and petitions that restrict the rights of others to speak. Yet, increasingly, we use our own free speech to call for that of others to be limited: for a misogynist UK comedian to be banned from our screens, or for a UK TV personality to be prosecuted by police for tweeting offensive jokes about ebola, or for a former secretary of state to be prevented from giving an address.

A project mapping media freedom in Europe, launched by Index just over six months ago, shows how journalists are increasingly targeted in this region, including – prior to last week’s incidents – 61 violent attacks against the media. Globally, the space for free expression is shrinking. We need to reverse this trend.

If you genuinely believe in the value of free speech – that all ideas and opinions must be heard – then that necessarily extends to the offensive and the vile. You don’t have to agree with someone, or condone what they are saying, or the manner in which it is said, but you do need to allow them to say it. The American Civil Liberties Union got this right in 1978 when they defended the rights of a pro-Nazi group to march in Chicago, arguing that rights to free expression needed apply to all if they were to apply to any. (As did charity EXIT-Germany late last year, when it raised money for an anti-fascism cause by donating money for every metre walked during a neo-Nazi march).

Countering offensive speech is – of course – only possible if you have the means to do so. Many have observed, rightly, that marginalisation and exclusion from mainstream media denies many people the voice that we would so vociferously defend for a free press. That is a valid argument. But this should be addressed – and must be addressed – by tackling this lack of access, not by shutting down the speech of those deemed to wield power and privilege.

Voltaire has been quoted endlessly in support of free expression, and the right to agree to disagree, but British author Neil Gaiman, who discusses satire and offence in the latest Index magazine, also had it right. “If you accept — and I do — that freedom of speech is important,” he once wrote, “then you are going to have to defend the indefensible. That means you are going to be defending the right of people to read, or to write, or to say, what you don’t say or like or want said…. Because if you don’t stand up for the stuff you don’t like, when they come for the stuff you do like, you’ve already lost.”

In the coming weeks, Index will redouble its efforts to build greater understanding of the benefits of free speech, to promote a better informed and wider public debate on censorship, and on offence. We will run a series of articles, public debates and workshops to encourage people to consider what it really means to support free expression, with the aim of reversing a tide of censorship-by-offence, and encouraging more speech, not less.

Index calls on UK to speak out against Bahraini human rights abuses after Rajab arrest

Nabeel Rajab, a prominent Bahraini human rights activist and Index award winner, has been detained for seven days while being investigated for claims that he offended the Ministry of Interior over Twitter.

Index CEO Jodie Ginsberg said: “Index is deeply concerned that the UK government has done little to press Bahrain to improve its human rights record. Instead the UK talks repeatedly of improvements in the human rights system in Bahrain when it is clear that rights such as freedom of expression are not being respected.” Index is writing to UK MPs to raise the case of Rajab.

On 1 October, Rajab, president of the Bahrain Centre for Human Rights (BCHR) and director of the Gulf Centre for Human Right (GCHR), was summoned by the cyber crimes unit of the Criminal Investigation Directorate. He is alleged to have “denigrated government institutions” on Twitter, according to the Ministry of Interior. Rajab was released in May after two years in prison on charges including making offensive tweets and taking part in illegal protests.

Rajab “has been targeted with repeated arrest and detention because of his work in the field of human rights” and “the government’s aim is to hinder his advocacy work both inside and outside of Bahrain”, said BCHR, Americans for Democracy and Human Rights in Bahrain (ADHRB) and the Bahrain Institute for Rights and Democracy (BIRD).

The arrest came shortly after Rajab’s return to Bahrain following an international trip to raise awareness of human rights violations in his country. He was calling for the release of human rights activists — and father and daughter — Maryam and Abdulhadi Al-Khawaja. Maryam has since been released on bail, her travel ban lifted and trial postponed until 5 November. Abdulhadi continues to serve the life sentence handed down to him in 2011, after playing a prominent role in the country’s pro-democracy protests that year.

While in London, Rajab told Index about the human rights and free speech situation in Bahrain, saying that “at least 50,000 people” had been in and out of jail in the past three months alone, “just for practising their right to freedom of assembly, freedom of gathering, freedom of expression”.

“It is time for Bahrain’s rulers to stop harassing human rights defenders and silencing free speech, and live up to their international obligations – including those they pledged again to uphold as part of the UN Universal Periodic Review just last month. Please, let our colleagues go free. Free Nabeel Rajab and drop the charges facing Rajab and the Al-Khawajas, ” GCHR said in a statement.
