Major new global free expression index sees UK ranking stumble across academic, digital and media freedom

A major new global ranking index tracking the state of free expression published today (Wednesday, 25 January) by Index on Censorship sees the UK ranked as only “partially open” in every key area measured.

In the overall rankings, the UK fell below countries including Australia, Israel, Costa Rica, Chile, Jamaica and Japan. European neighbours such as Austria, Belgium, France, Germany and Denmark also all rank higher than the UK.

The Index Index, developed by Index on Censorship and experts in machine learning and journalism at Liverpool John Moores University (LJMU), uses innovative machine learning techniques to map the free expression landscape across the globe, giving a country-by-country view of the state of free expression across academic, digital and media/press freedoms.

Key findings include:

  • The countries with the highest ranking (“open”) on the overall Index are clustered around western Europe and Australasia – Australia, Austria, Belgium, Costa Rica, Denmark, Estonia, Finland, Germany, Ireland, Latvia, Lithuania, Netherlands, New Zealand, Norway, Portugal, Sweden and Switzerland.

  • The UK and USA join countries such as Botswana, Czechia, Greece, Moldova, Panama, Romania, South Africa and Tunisia ranked as “partially open”.

  • The poorest performing countries across all metrics, ranked as “closed”, are Bahrain, Belarus, Burma/Myanmar, China, Cuba, Equatorial Guinea, Eritrea, Eswatini, Laos, Nicaragua, North Korea, Saudi Arabia, South Sudan, Syria, Turkmenistan, United Arab Emirates and Yemen.

  • Countries such as China, Russia, Saudi Arabia and United Arab Emirates performed poorly in the Index Index but are embedded in key international mechanisms including G20 and the UN Security Council.

Ruth Anderson, Index on Censorship CEO, said:

“The launch of the new Index Index is a landmark moment in how we track freedom of expression in key areas across the world. Index on Censorship and the team at Liverpool John Moores University have developed a rankings system that provides a unique insight into the freedom of expression landscape in every country for which data is available.

“The findings of the pilot project are illuminating, surprising and concerning in equal measure. The United Kingdom ranking may well raise some eyebrows, though is not entirely unexpected. Index on Censorship’s recent work on issues as diverse as Chinese Communist Party influence in the art world through to the chilling effect of the UK Government’s Online Safety Bill all point to backward steps for a country that has long viewed itself as a bastion of freedom of expression.

“On a global scale, the Index Index shines a light once again on those countries such as China, Russia, Saudi Arabia and United Arab Emirates with considerable influence on international bodies and mechanisms – but with barely any protections for freedom of expression across the digital, academic and media spheres.”

Nik Williams, Index on Censorship policy and campaigns officer, said:

“With global threats to free expression growing, developing an accurate country-by-country view of threats to academic, digital and media freedom is the first necessary step towards identifying what needs to change. With gaps in current data sets, it is hoped that future ‘Index Index’ rankings will have further country-level data that can be verified and shared with partners and policy-makers.

“As the ‘Index Index’ grows and develops beyond this pilot year, it will not only map threats to free expression but also where we need to focus our efforts to ensure that academics, artists, writers, journalists, campaigners and civil society do not suffer in silence.”

Steve Harrison, LJMU senior lecturer in journalism, said: 

“Journalists need credible and authoritative sources of information to counter the glut of dis-information and downright untruths which we’re being bombarded with these days. The Index Index is one such source, and LJMU is proud to have played our part in developing it.

“We hope it becomes a useful tool for journalists investigating censorship, as well as a learning resource for students. Journalism has been defined as providing information someone, somewhere wants suppressed – the Index Index goes some way to living up to that definition.”

In celebration of one of football’s biggest international tournaments, here is Index’s guide to the free speech Euros. Who comes out on top as the nation with the worst record on free speech?

It’s simple, the worst is ranked first.

We continue today with Group B, which plays the deciding matches of the group stages today.

1st Russia

Unlike their relatively miserable performances on the football pitch, Russia can approach this particular contest as the clear favourites.

The group would be locked up after the first two games, with some sensational play from their three talismans: disinformation, oppressive legislation and attacks on independent media.

Russian disinformation, through the use of social media bots and troll factories, is well known, as is their persistent meddling in foreign elections which infringes on the rights of many to exercise their right to vote based on clear information.

Putin’s Russia has increased its attacks on free speech ever since the 2011 protests over a flawed election process. When protests arose once again all over the country in January 2021 over the detention of former opposition leader Alexei Navalny, over 10,000 people were arrested across the country, with many protests violently dispersed.

Police in the country must first be warned before a protest takes place. A single-person picket is the only form of protest that does not have this requirement. Nevertheless, 388 people were detained in Russia for this very act in the first half of 2020 alone, despite not needing to notify the authorities that eventually arrested them.

Human rights organisation, the Council of Europe (COE), expressed its concerns over Russian authorities’ reactions to the Navalny protests.

Commissioner Dunja Mijatović said: “This disregard for human rights, democracy and the rule of law is unfortunately not a new phenomenon in a country where human rights defenders, journalists and civil society are regularly harassed, including through highly questionable judicial decisions.”

Unfortunately, journalists attempting to monitor these appalling free speech violations face a squeeze on their platforms. Independent media is being deliberately targeted. Popular news site Meduza, for example, is under threat from Russia’s ‘foreign agents’ law.

The law, which free expression non-profit Reporters Without Borders describes as “nonsensical and incomprehensible”, means that organisations with dissenting opinions receiving donations from abroad are deemed to be “foreign agents”.

Those who do not register as foreign agents can receive up to five years’ imprisonment.

Being added to the register causes advertisers to drop out, meaning that revenue for the news sites drops dramatically. Meduza were forces to cut staff salaries by between 30 to 50 per cent.

2nd Belgium

Belgium is relatively successful in combating attacks on free speech. It does, however, make such attacks arguably more of a shock to the system than it may do elsewhere.

The coronavirus pandemic was, of course, a trying time for governments everywhere. But troubling times do not give leaders a mandate to ignore public scrutiny and questioning from journalists.

Alexandre Penasse, editor of news site Kairos, was banned from press conferences after being accused by the prime minister of provocation, while cartoonist Stephen Degryse received online threats after a cartoon that showed the Chinese flag with biohazard symbols instead of stars.

Incidents tend to be spaced apart, but notable. In 2020, journalist Jérémy Audouard was arrested when filming a Black Lives Matter protest. According to the Council of Europe “The policeman tried several times to prevent the journalist, who was showing his press card, from filming the violent arrest of a protester lying on the ground by six policemen.”

There is an interesting debate around holocaust denial, however and it is perhaps the issue most indicative of Belgium’s stance on free speech.

Holocaust denial, abhorrent as it may be, is protected speech in most countries with freedom of expression. It is at least accepted as a view that people are entitled to, however ridiculous and harmful such views are.

The law means that anyone who chooses to “deny, play down, justify or approve of the genocide committed by the German National Socialist regime during the Second World War” can be imprisoned or fined.

Belgium has also considered laws that would make similar denials of genocides, such as the Rwandan and Armenian genocides respectively, but was unable to pursue this due to the protestations of some in the Belgian senate and Turkish communities. It could be argued that in some areas, it is hard to establish what constitutes as ‘denial’, therefore, choosing to ban such views is problematic and could set an unwelcome precedent for future law making regarding free speech.

Comparable legal propositions have reared over the years. In 2012, fines were introduced for using offensive language. Then mayor Freddy Thielemans was quoted as saying “Any form of insult is from now on [is] punishable, whether it be racist, homophobic or otherwise”.

3rd Denmark

Denmark has one of the best records on free speech in the world and it is protected in the constitution. It makes a strong case to be the lowest ranked team in the tournament in terms of free speech violations. It is perhaps unfortunate then, that they were drawn in a group with their fellow Scandinavians.

Nevertheless, no country’s record on free speech is perfect and there have been some concerning cases in the country over the last few years.

2013 saw a contentious bill approved by the Danish Parliament “reduced the availability of documents prepared”, according to freedominfo.org. Essentially, it was argued that this was a restriction of freedom of information requests which are vital tool for journalists seeking to garner correct and useful information.

Acts against freedom of speech tend to be individual acts, rather than a persistent agenda.

Impartial media is vital to upholding democratic values in a state. But, in 2018, public service broadcaster DR was subjected to a funding cut of 20 per cent by the right-wing coalition government.

DR were forced to cut around 400 jobs, according to the European Federation of Journalists, an act that was described as “revenge” at the time.

There have been improvements elsewhere. In 2017, Denmark scrapped its 337-year-old blasphemy law, which previously forbade public insults of religion. At the time, it was the only Scandinavian country to have such a law. According to The Guardian, MP Bruno Jerup said at the time: “Religion should not dictate what is allowed and what is forbidden to say publicly”.

The change to the law was controversial: a Danish man who filmed himself burning the Quran in 2015 would have faced a blasphemy trial before the law was scrapped.

In 2020, Danish illustrator Niels Bo Bojesen was working for daily newspaper Jyllands-Posten and replaced the stars of the Chinese flag with symbols of the coronavirus.

Jyllands-Posten refused to issue the apology the Chinese embassy demanded.

The Council of Europe has reported no new violations of media freedom in 2021.

4th Finland

A good record across the board, Finland is internationally recognised as a country that upholds democracy well.

Index exists on the principle that censorship can and will exist anywhere there are voices to be heard, but it wouldn’t be too crass of us to say that the world would be slightly easier to peer through our fingers at if its record on key rights and civil liberties were a little more like Finland’s.

It is joint top with Norway and Sweden of non-profit Freedom House’s Global Freedom Index of 2021, third in Transparency International’s Corruption Perceptions Index 2020, sixth in The Economist’s Democracy Index 2020 and second in RSF’s World Press Freedom Index.

Add that together and you have a country with good free speech protections.

That is not to say, though, that when cases of free speech violations do arise, they can be very serious indeed.

In 2019, the Committee to Project Journalists (CPJ) called for Finnish authorities to drop charges against journalist Johanna Vehkoo.

Vehkoo described Oulou City Councilor Junes Lokka as a “Nazi clown” in a private Facebook group.

A statement by the CPJ said: “Junes Lokka should stop trying to intimidate Johanna Vehkoo, and Finnish authorities should drop these charges rather than enable a politician’s campaign of harassment against a journalist.”

“Finland should scrap its criminal defamation laws; they have no place in a democracy.”

Indeed, Finnish defamation laws are considered too harsh, as a study by Ville Manninen on the subject of media pluralism in Europe, found.

“Risks stem from the persistent criminalization of defamation and the potential of relatively harsh punishment. According to law, (aggravated) defamation is punishable by up to two years imprisonment, which is considered an excessive deterrent. Severe punishments, however, are used extremely rare, and aggravated defamation is usually punished by fines or parole.”

The study also spoke of another problem, that of increased harassment or threats towards journalists.

Reporter Laura Halminen had her home searched without a warrant after co-authoring an article concerning confidential intelligence.

Majority of editors worry that local newspapers do not have the resources to hold the powerful to account in the way they did in the past, says new report

Ninety seven per cent of senior journalists and editors working for the UK’s regional newspapers and news sites say they worry that that local newspapers do not have the resources to hold power to account in the way that they did in the past, according to a survey carried out by the Society of Editors and Index on Censorship. And 70% of those respondents surveyed for a special report published in Index on Censorship magazine are worried a lot about this.

The survey, carried out in February 2019 for the spring issue of Index on Censorship magazine, asked for responses from senior journalists and current and former editors working in regional journalism. It was part of work carried out for this magazine to discover the biggest challenges ahead for local journalists and the concerns about declining local journalism has on holding the powerful to account.

The survey found that 50% of editors and journalists are most worried that no one will be doing the difficult stories in future, and 43% that the public’s right to know will disappear. A small number worry most that there will be too much emphasis on light, funny stories.

There are some specific issues that editors worry about, such as covering court cases and council meetings with limited resources.

Twenty editors surveyed say that they feel only half as much local news is getting covered in their area compared with a decade ago, with 15 respondents saying that about 10% less news is getting covered. And 74% say their news outlet covers court cases once a week, and 18% say they hardly ever cover courts.  

The special report also includes a YouGov poll commissioned for Index on public attitudes to local journalism. Forty per cent of British adults over the age of 65 think that the public know less about what is happening in areas where local newspapers have closed, according to the poll.

Meanwhile, 26% of over-65s say that local politicians have too much power where local newspapers have closed, compared with only 16% of 18 to 24-year-olds. This is according to YouGov data drawn from a representative sample of 1,840 British adults polled on 21-22 February 2019.

Index on Censorship editor Rachael Jolley said: “Big ideas are needed. Democracy loses if local news disappears. Sadly, those long-held checks and balances are fracturing, and there are few replacements on the horizon. Proper journalism cannot be replaced by people tweeting their opinions and the occasional photo of a squirrel, no matter how amusing the squirrel might be.”

She added: “If no local reporters are left living and working in these communities, are they really going to care about those places? News will go unreported; stories will not be told; people will not know what has happened in their towns and communities.”

Others interviewed for the magazine on local news included:

Michael Sassi, editor of the Nottingham Post and the Nottingham Live website, who said: “There’s no doubt that local decision-makers aren’t subject to the level of scrutiny they once were.”

Lord Judge, former lord chief justice for England and Wales, said: “As the number of newspapers declines and fewer journalists attend court, particularly in courts outside London and the major cities, and except in high profile cases, the  necessary public scrutiny of the judicial process will be steadily eroded,eventually to virtual extinction.”

US historian and author Tim Snyder said: “The policy thing is that government – whether it is the EU or the United States or individual states – has to create the conditions where local media can flourish.”

“A less informed society where news is replaced by public relations, reactive commentary and agenda management by corporations and governments will become dangerously volatile and open to manipulation by special interests. Allan Prosser, editor of the Irish Examiner.

Artist in Exile: Eddy Munyaneza driven to become the man behind the camera

[vc_row][vc_column][vc_single_image image=”104099″ img_size=”full”][vc_column_text]“If you want to make films in Burundi, you either self-censor and you remain in the country or if you don’t, you have to flee the country,” Eddy Munyaneza, a Burundian documentary filmmaker, told Index on Censorship.

Munyaneza became fascinated in the process of filmmaking at a young age, despite the lack of cinematic resources in Burundi.

He now is the man behind the camera and has released three documentaries since 2010, two of which have drawn the ire of the Burundian government and forced Munyaneza into exile.

His first documentary — Histoire d’une haine manquée — was released in 2010 and has received awards from international and African festivals. The film is based on his personal experience of the Burundian genocide of 1993, which took place after the assassination of the country’s first democratically elected Hutu president Ndadye Melchoir. It focuses on the compassionate actions he witnessed when his Hutu neighbours saved him and his Tutsi sisters from the mass killings that swept the country. The film launched Munyaneza’s career as a filmmaker.

Munyaneza was honoured by Burundi’s president Pierre Nkurunziza for his first film and his work was praised by government officials. But the accolades faded when he turned his camera toward Nkurunziza for his second film in 2016.

The film, Le Troisieme Vide, focused on the two-year political crisis and president’s mandate that followed Nkurunziza’s campaign for an unconstitutional third term in April 2015. During the following two years, between 500 and 2,000 people were tortured and killed, and 400,000 were  exiled.

The filming of his second documentary was disrupted when Munyaneza started receiving death threats from the government’s secret service. He was forced to seek asylum in Belgium in 2016 for fear of his life. Through perseverance and passion, he quietly returned to Burundi in July 2016 and April 2017 to finish his short film.

Exile hasn’t affected Munyaneza’s work: in 2018 he released his third film, Lendemains incertains. It tells the stories of Burundians who have stayed or left the country during the 2015 political tension. He secretely returned to Burundi to capture additional footage for his new film, which premiered in Brussels at the Palace Cinema and several festivals.

“I lead a double life, my helplessness away from my loved ones, and the success of the film on the other,” he said. He continues to work in exile, but also works toward returning to Burundi to see his wife and kids who currently reside in a refugee camp in Rwanda, and to create film, photography and audio programs for aspiring Burundian filmmakers.

Gillian Trudeau from Index on Censorship spoke with Munyaneza about his award-winning documentaries and time in exile.

Index: In a country that doesn’t have an abundance of film or cinema resources, how did you become so passionate about filmmaking?

Munyaneza: I was born in a little village where there was no access to electricity or television. At the age of 7, I could go into town for Sunday worship. After the first service, I would go to the cinema in the centre of the town of Gitega. We watched American movies about the Vietnam war and karate films, as well as other action movies which are attractive to young people. After the film my friends and I would have debates about the reality and whether they had been filmed by satellites. I was always against that idea and told them that behind everything there was someone who was making the film, and I was curious to know how they did it.  That’s why since that time I’ve been interested in the cinema. Unfortunately, in Burundi, there is no film school. After I finished school in 2002, I began to learn by doing. I was given the opportunity to work with a company called MENYA MEDIA which was getting into audiovisual production and I got training in lots of different things, cinema, writing, and I began to make promotional films. The more I worked, the more I learned.

Index: How would you characterise  artistic freedom in Burundi today, and is that any different to when you were growing up?

Munyaneza: To be honest, Burundian cinema really got going with the arrival of digital in the 2000s. Before 2000 there was a feature film called Gito L’Ingrat which was shot in 1992 and directed by Lionce Ngabo and produced by Jacques Sando. After that, there were some productions by National Television and other documentary projects for TV made in-house by National Television. I won’t say that the artistic freedom in those days was so different from today. The evidence is that since those years, I can say after independence, there have not been Burundian filmmakers who have made films about Burundi (either fictional or factual). There were not really any Burundian films made by independent filmmakers between 1960 and 1990. The man who dared to make a film about the 1993 crisis, Kiza by Joseph Bitamba, was forced to go into exile, just as I have been forced to go into exile for my film about the events of  2015. So if you want to make films in Burundi, you either self-censor and you remain in the country or if you don’t, you have to flee the country.

Index: You began receiving threats after you made your second film, Le troisieme vide, in 2016. The film focused on the political crisis that followed the re-election of president Nkurunziza. Why do you think the film received such a reaction?

Munyaneza: Troisieme Vide is a short film which was my final project at the end of my masters in cinema at Saint Louis in Senegal. I knew that just making a film about the 2015 crisis would spark debate. Talking about the events which led to the 2015 crisis, caused by a president who ran for a third term, which he is not allowed to do by the constitution, I was sure that when this film came out I would have problems with the government. But I am not going to be silent like people who are older than me have done, who did not document what went on in Burundi from the 1960s, and have in effect just made the lie bigger. I want to escape this Burundian fate, to at least leave something for the generations to come.    

Index: How did you come to the decision to leave Burundi and what did that feel like?

Munyaneza: Burundi is a beautiful country with a beautiful climate. My whole history is there – my family, my friends. It is too difficult to leave your history behind. The road into exile is something you are obliged to do. It’s not a decision, it’s a question of life or death.

Index: How is life in Belgium, being away from your wife and children?

Munyaneza: It is very difficult for me to continue to live far from my family ties. I miss my children. I remain in this state of powerlessness, unable to do anything for them, to educate them or speak to them. It is difficult to sleep without knowing under what roof they are sleeping.

Index: How has your time in exile affected your work?

Munyaneza: On the work front, there is the film which is making its way. It has been chosen for lots of festivals and awards. I have just got the prize (trophy) for best documentary at the African Movie Academy Award 2018. I was invited but I couldn’t go. I lead a double life, my helplessness away from my loved ones, and the success of the film on the other. I have been invited to several festivals to present my film, but I don’t have the right to leave the country because of my refugee status. I am under international protection here in Belgium.

Index: You have returned to your home country on several occasions to film footage for your films. What dangers are your putting yourself in by doing this? And what drives you to take these risks?

Munyaneza: I risked going back to Burundi in July 2016 and in April 2017 to finish my film. To be honest, I didn’t know how the film was going to end up and sometimes I believed that by negotiating with the politicians it could take end up differently. When you are outside (the country) you get lots of information both from pro-government people and from the opposition. The artist that I am I wanted to go and see for myself and film the situation as it was. Perhaps it was a little crazy on my part but I felt an obligation to do it.

Index: Your most recent film, Uncertain Endings, looks at the violence the country has faced since 2015. In it, you show the repression of peaceful protesters. Why are demonstrators treated in such a way and what does this say about the future of the country?

Munyaneza: The selection of Pierre Nkurunziza as the candidate for the Cndd-FDD after the party conference on 25 April provoked a wave of demonstrations in the country. The opposition and numerous civil society bodies judged that a third term for President Nkurinziza would be unconstitutional and against the Arusha accords which paved the way for the end of the long Burundian civil war (1993-2006).  These young people are fighting to make sure these accords, which got the country out of a crisis and have stood for years, are followed. Unfortunately, because of this repression, we are back to where we started. In fact, we are returning to the cyclical crises which has been going on in Burundi since the 1960s. But what I learnt from the young people was that the Burundian problem was not based on ethnic divides as we were always told. There were both Hutu and Tutsi there, both taking part in defending the constitution and the Arusha accords. It is the politicians who are manipulating us.

Index: Do you hold out any hope of improvements in Burundi? Do you hope one day to be able to return to your home country?

Munyaneza: After the rain, the sun will reappear.  Today it’s a little difficult, but I am sure that politicians will find a way of getting out of this crisis so that we can build this little country. I am sure that one day I’ll go back and make films about my society. I don’t just have to tell stories about the crisis.
