On the anniversary of the brutal attack on the offices of Charlie Hebdo we, the undersigned, reaffirm our commitment to the defence of the right to freedom of expression, even when that right is being used to express views that some may consider offensive.
The Charlie Hebdo attack, which left 11 dead and 12 wounded, was a horrific reminder of the violence to which journalists, artists and other critical voices are subjected in a global atmosphere marked by increasing intolerance of dissent. The killings inaugurated a year that has proved especially challenging for proponents of freedom of opinion.
Non-state actors perpetrated violence against their critics largely with impunity, including the brutal murders of four secular bloggers in Bangladesh by Islamist extremists, and the killing of an academic, M M Kalburgi, who wrote critically against Hindu fundamentalism in India.
Despite the turnout of world leaders on the streets of Paris in an unprecedented display of solidarity with free expression following the Charlie Hebdo murders, artists and writers faced intense repression from governments throughout the year. In Malaysia, cartoonist Zunar is facing a possible 43-year prison sentence for alleged ‘sedition’; in Iran, cartoonist Atena Fardaghani is serving a 12-year sentence for a political cartoon; and in Saudi Arabia, Palestinian poet Ashraf Fayadh was sentenced to death for the views he expressed in his poetry.
Perhaps the most far-reaching threats to freedom of expression in 2015 came from governments ostensibly motivated by security concerns. Following the attack on Charlie Hebdo, 11 interior ministers from European Union countries including France, Britain and Germany issued a statement in which they called on Internet service providers to identify and remove online content ‘that aims to incite hatred and terror.’ In July, the French Senate passed a controversial law giving sweeping new powers to the intelligence agencies to spy on citizens, which the UN Human Rights Committee categorised as “excessively broad”.
This kind of governmental response is chilling because a particularly insidious threat to our right to free expression is self-censorship. In order to fully exercise the right to freedom of expression, individuals must be able to communicate without fear of intrusion by the State. Under international law, the right to freedom of expression also protects speech that some may find shocking, offensive or disturbing. Importantly, the right to freedom of expression means that those who feel offended also have the right to challenge others through free debate and open discussion, or through peaceful protest.
On the anniversary of the Charlie Hebdo attacks, we, the undersigned, call on all Governments to:
- Uphold their international obligations to protect the rights of freedom of expression and information for all, and especially for journalists, writers, artists and human rights defenders to publish, write and speak freely;
- Promote a safe and enabling environment for those who exercise their right to freedom of expression, and ensure that journalists, artists and human rights defenders may perform their work without interference;
- Combat impunity for threats and violations aimed at journalists and others exercising their right to freedom of expression, and ensure impartial, timely and thorough investigations that bring the executors and masterminds behind such crimes to justice. Also ensure victims and their families have expedient access to appropriate remedies;
- Repeal legislation which restricts the right to legitimate freedom of expression, especially vague and overbroad national security, sedition, obscenity, blasphemy and criminal defamation laws, and other legislation used to imprison, harass and silence critical voices, including on social media and online;
- Ensure that respect for human rights is at the heart of communication surveillance policy. Laws and legal standards governing communication surveillance must therefore be updated, strengthened and brought under legislative and judicial control. Any interference can only be justified if it is clearly defined by law, pursues a legitimate aim and is strictly necessary to the aim pursued.

There are a few techniques you can use to spot whether someone has slightly dodgy views on the world.
My favourite is the hand-chopping test. Imagine, if you will, that you find yourself debating on a panel with a media-friendly community activist. He was very jovial in the dressing room, knows all the right words about the European Convention on Human Rights and a little bit about the emancipation of women. All the nice things. But something seems a bit shady. You’ve heard he’s associated with some rather dubious types. Try this: ask if they think thieves should have their hands cut off. If they say: “What an odd question. Of course not!”, they’re probably fairly normal people, but they won’t be your friend because they reckon you’re probably Islamophobic. But if they start waffling about the “Sharia being properly implemented… in an Islamic State the Sharia would necessarily… something something scholars…” etc, you are in all likelihood sharing a stage with someone who’s a bit, well…
Well what, exactly? Dodgy, yes. The test has served to establish that much. But does it mean they’re probably going to join the Islamic State immediately after you’ve finished your panel debate? Or encourage others to do so?
Probably not. We don’t really know.
Take another example. You’re at a bus stop late at night when you overhear a middle-aged man next to you railing against refugees to a young woman. Is he simply an anti-immigrant little-Englander? What if he starts explaining that the current refugee crisis has been caused not by Assad or IS, or oppressive governments in say, Eritrea, but by the machinations of “Rothschild Zionists” who are determined to flood Europe with dark-skinned people in order to pollute the continent’s Aryan bloodstock?
The UK government would class the beliefs outlined above as “extreme”. Indeed, in its newly-outlined counter-extremism strategy, it focuses almost exclusively on Islamism and neo-Nazism, which might come as a relief to anarchists, deep greens, animal rights activists and physical-force Irish republicans.
I’m not about to debate the merits of the term “extremism” itself. Yes, “extreme” is by its nature a relative term, and things change over time: the Prussian secret police who spied on Karl Marx in London as he wrote Das Kapital surely would have identified him as an extremist, but could not have possibly imagined his ideas would become so very prominent in the corridors of mainstream academia a century later.
The ideas of extreme Islamists and the far right, it is probably reasonable to say, are far from the mainstream of British society. And violence is carried out in their name. These seem reasonable assertions.
The question then is whether the government should do something about their existence. And if so, what?
The new counter-extremism strategy does at least attempt to identify specifics of what extremism might be and also shows some actual knowledge of the identified problems as specific political projects rather than floating notions.
But it’s still not entirely clear whether the ultimate aim is to prevent acts of terrorism carried out by extremists or to prevent general wrongs.
It is of interest, for example, to note that violence against women and girls, including genital mutilation, is identified. But I’m not sure that the “root causes” can be linked simply to the forms of extremism mentioned in the strategy document.
There are other issues that will also raise concern for those interested in free expression.
In an age when stories about who can and cannot speak on university campuses have become a staple of discussion, the government’s assertion that it expects “student bodies such as the NUS to avoid providing a platform for extremist speakers” feels like yet another incursion onto the idea that universities should be free spaces.
The suggestion that “the government will challenge broadcasters whenever extremists have been given a platform to preach harmful messages without critical challenge” appears to be moving beyond the existing role of Ofcom in promoting balance on the airwaves.
This is underlined by the pledge to “legislate in this parliament to ensure Ofcom’s existing powers to immediately suspend TV services that broadcast unacceptable extremist material also extend to all radio services” and to “consider changes” to regulation around shows that appear on the web.
We ultimately return to the challenge of our jovial preacher on the panel debate or our bus-stop Streicher.
As individuals and as a society, what do we want to do with them? Convince them that they are wrong and that liberal democracy is the way to go? The government suggests it will “act with confidence, unapologetically defending our shared values and robustly confronting extremists”.
This is important, certainly, and is something that must be put into practice in places such as prisons where the path to radicalisation and possible violence is at its clearest.
But it’s crucial that is seen as an act rather than an idea: the crime is to plant the bomb or recruit, fundraise for violence in the name of the Islamic State, or attempt to foment race war longed for by Nazis. The crime cannot be simply to believe in the Islamic State or the race war. We come back (as we so frequently do) to John Stuart Mill’s harm principle: “The only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others.”

Index on Censorship is a global quarterly magazine with reporters and contributing editors around the world. Founded in 1972, it promotes and defends the right to freedom of expression.
We are often, rightly, concerned about our politicians censoring us. The power of the state, combined with the obvious temptation to quiet criticism, is a constant threat to our freedom to speak. It’s important we watch our rulers closely and are alert to their machinations when it comes to our right to ridicule, attack and examine them. But here in the West, where, with the best will in the world, our politicians are somewhat lacking in the iron rod of tyranny most of the time, I’m beginning to wonder whether we may not have turned the tables on our politicians to the detriment of public discourse.
Let me give you an example. In the UK, once a year the major political parties pack up sticks and spend a week each in a corner of parochial England, or sometimes Scotland. The party conferences bring activists, ministers, lobbyists and journalists together for discussion and debate, or at least, that’s the idea. Inevitably these weird gatherings of Westminster insiders and the party faithful have become more sterilised over the years; the speeches are vetted, the members themselves are discouraged from attending, the husbandly patting of the wife’s stomach after the leader’s speech is expertly choreographed. But this year, all pretence that these events were a chance for the free expression of ideas and opinions was dropped.
Lord Freud, a charming and thoughtful – if politically naïve – Conservative minister in the UK, was caught committing an appalling crime. Asked a question of theoretical policy by an audience member at a fringe meeting, Freud gave an answer. “Yes,” he said, he could understand why enforcing the minimum wage might mean accidentally forcing those with physical and learning difficulties out of the work place. What Freud didn’t know was that he was being covertly recorded. Nor that his words would then be released at the moment of most critical, political damage to him and his party. Or, finally, that his attempt to answer the question put to him would result in the kind of social media outrage that is usually reserved for mass murderers and foreign dictators.
Why? He wasn’t announcing government policy. He was thinking aloud, throwing ideas around in a forum where political and philosophical debate are the name of the game, not drafting legislation. What’s more, the kind of policy upon which he was musing is the kind of policy that just a few short years before disability charities were punting themselves. So why the fuss?
It’s not solely an issue for British politics. Consider the case of Donald Rumsfeld. Now, there’s plenty about which to potentially disagree with the former US secretary of state for defense – from the principles of a just war to the logistics of fighting a successful conflict – but what is he most famous for? Talking about America’s ongoing conflicts in the Middle East, he thought aloud, saying “because as we know, there are known knowns; there are things we know we know. We also know there are known unknowns; that is to say we know there are some things we do not know. But there are also unknown unknowns – the ones we don’t know we don’t know.” The response? Derision, accompanied by the sense that in speaking thus Rumsfeld was somehow demonstrating the innate ignorance and stupidity of the administration he served. Never mind that, to me at least, his taxonomy of doubt makes perfect sense – the point is this: when a politician speaks in anything other than the smooth, scripted pap of the media relations machine they are wont to be crucified on a cross of either outrage, mockery or both. Why? Because we don’t allow our politicians to muse any longer. We expect them to present us with well-polished packages of pre-spun, offence-free, fully-formed answers packed with the kind of delusional certainty we now demand of our rulers. Any deviation – be it a “U-turn”, an “I don’t know” or a “maybe” – is punished mercilessly by the media mob and the social media censors that now drive 24-hour news coverage.
Let me be clear about what I don’t mean. I am not upset about “political correctness” – or manners, as those of us with any would call it – and I am not angry that people object to ideas and policies with which they disagree. I am worried that as we close down the avenues for discussion, debate and indeed for dissent if we box our politicians in whenever they try to consider options in public – not by arguing but by howling with outrage and demanding their head – then we will exacerbate two worrying trends in our politics.
First, the consensus will be arrived at in safe spaces, behind closed doors. Politicians will speak only to other politicians until they are certain of themselves and of their “line- to-take”. They will present themselves ever more blandly and ever less honestly to the public and the notion that our ruling class is homogenous, boring and cowardly will grow still further.
Which leads us to a second, interrelated consequence – the rise of the taboo-breaker. Men – and it is, for the most part, men – such as Nigel Farage and Russell Brand in the UK, Beppe Grillo in Italy, Jon Gnarr in Iceland, storm to power on their supposed daringness. They say what other politicians will not say and the relief that they supply to that portion of the population who find the tedium of our politics both unbearable and offensive is palpable. It is only a veneer of radicalism, of course – built often from a hodge-podge of fringe beliefs and personal vanity – but the willingness to break the rules captures the imagination and renders scrutiny impotent. Where there are no ideas to be debated the clown is the most interesting man in the room.
They say we get the politicians we deserve. And when it comes to the twin plaques of modern politics you can see what they mean. On the one hand we sit, fingers hovering over keyboards, ready to express our disgust at the latest “gaffe” from a minister trying to think things through. On the other we complain about how boring, monotonous and uninspiring they all are, so vote for a populist to “make a point”. Who is to blame? We are. It is time to self-censor, to show some self-restraint, and to stop censoring our politicians into oblivion.
